The Workplace Disputes Section will offer a group discussion on the Good, the Bad and the Ugly of ADR. Experienced mediators will facilitate a discussion of positive, negative and unethical ADR experiences. What can we learn from these experiences? Participants will meet in small groups, prepare short case studies representing their own ADR experiences and reconvene to discuss the case studies in the large group.
Come prepared to ask the tough questions. For example: You observe a mediation and are convinced that the case would settle if the attorneys had better control of their clients. What should you do? What should the mediator do? A mediator tells you about a potential conflict of interest in a case. What's your advice? Counsel for a party tells you that the mediator "forced" the parties to reach a settlement. What do you do? Bring us your war stories.
