
In 2000 and 2006, the Federal Interagency ADR Working Group Steering Committee (IADRWG) issued guidance concerning the confidentiality protections under the 1996 Administrative Dispute Resolution Act. While this guidance has been helpful to mediators and ADR program administrators, we continue to experience challenges in its application.
In this interactive session, we will highlight the main points of the confidentiality guidance issued by the IADRWG. Participants will also engage in an exercise and share how they have addressed confidentiality issues in mediation.
