For FY 2002, the budget does not include funds for the Byrne Discretionary Grant Program, a reduction of $69,397,000. The original purpose of this program, which was to give the Department discretionary funding for anti-drug activities, has not been possible in recent years due to the level of earmarking within this program, which has limited OJP's ability to address new and innovative criminal justice initiatives. Traditionally, the discretionary grant program served as a vehicle to fund OJP and Administration initiatives in the area of state and local criminal justice improvements in topics ranging form gun safety, drug testing, alternatives to incarceration, and community-based justice. In 2001, 94 percent of the discretionary program was earmarked.

Local Law Enforcement Block Grant ... ... (121,849)
       
The 2002 budget proposes reducing funding for the Local Law Enforcement Block Grant (LLEBG) by $121,849,000. The total FY 2002 request is for $400,000,000. The impact on local governments from a reduction in this program, which has remained unauthorized outside of appropriations language, is offset by substantial increases in state and local assistance for technology, DNA backlog reductions, crime lab improvements, and other criminal justice system needs, elsewhere in this budget.      
       
State Criminal Alien Assistance Program ... ... (298,757)
       
The Department is requesting $265 million for the State Criminal Alien Assistance Program (SCAAP), which is $298.76 million below the 2002 base. Since the Program's inception in 1995, OJP has distributed approximately $3.5 billion to the states for the incarceration of certain categories of convicted aliens. The 2002 budget proposes to fund this program at a level just below the amount authorized for SCAAP in FY 1996. Even though this program is not authorized for FY 2002 (the five-year authorization ends in FY 2001), the Department is seeking to continue the initiative.      
       
Prison Grant Program ... ... (520,353)
       
Since FY1996, the Prison Grants program has provided more than $2.3 billion ($520.4 million in FY 2001) in funding for the construction of 24,788 new beds around the country to encourage the adoption of Violent Offender Incarceration/Truth-in-Sentencing (VOI/TIS) laws. Nearly five years has passed since the program's inception, and 30 states have enacted VOI/TIS laws. At present, there are no further prospects for participation by additional states, and thus the program has achieved as much of its original purpose as possible.

This program was previously funded within the VOI/TIS. It is proposed as a separate, stand-alone program in FY 2002.

Violence Against Women Act Programs ... ... 101,721
       
In response to the passage of the Victims of Trafficking and Violence Protection Act of 2000 (P.L. 106-386), the FY 2002 Budget proses several new enhancements, and increases to current programs in the VAWA Program Office. The enhancements include: a $31 million increase to encourage arrest policies; $15 million increase for rural domestic violence enforcement; $3 million increase for Access to Federal Criminal Information initiative; a $15 million increase for Safe Havens/Visitation; a $200,000 for a report on parental kidnaping; a $200,000 for a Study on Sexual Assault Forensic Exams; $7.5 million for Education and Training for to end violence against and abuse of women with disabilities; $40 million to provide legal assistance to victims; $10 million for Grants to Reduce Violent Crime Against Women on Campus; $5 million for Enhancing Protections for Older and Disabled Women from Domestic Violence and Sexual Assault.

The budget proposes an increase of $500,000 for the the Court-Appointed Special Advocate Program, and $300,000 for Training for Judicial Personnel.      
       
Residential Substance Abuse Treatment Program ... ... 11,000
       
This program provides formula grants to states for use by state and local government to develop and implement residential substance abuse programs within state and local correctional and detention facilities where inmates are incarcerated for a sufficient period of time to permit such treatment. This increase will provide a total of $73.861 million for RSAT.      
       
Management and Administration [17] [9] [924]
       
Within the overall funding request, 17 positions and 9 workyears will be used to increase support for OJP programs. This additional administrative funding will be used to ensure that there is effective management of the programs proposed under this appropriation.
