This appropriation is used to pay fees and expenses to witnesses who appear on behalf of the Government in litigation in which the United States is a party.  There are many factors over which the Department of Justice has little, or no, control that affect the costs incurred.  The U.S. Attorneys, the U.S. Marshals, and the six litigating divisions are served by this appropriation.
                           
Program Improvements by Strategic Goal                      
                           
Goal 2: Enforce Federal Laws and Represent the Rights and Interests of the American People 0 0 $21,440
                           
1.  Expert Witnesses      
Additional funding of $21,140,000 is requested as expert witness costs for FY 2005 are expected to increase for several of the Department’s larger expert witness users in the areas that continue to expand such as financial fraud, violent crime, environmental protection, and voting rights.  Total FY 2005 current services resources for this initiative are $116,145,000.       
     
                           
2.  Alternative Dispute Resolution (ADR)      
Additional funding of $300,000 is requested to enhance ADR because the Office of Dispute Resolution has had to authorize the payment of increased hourly fees in order to continue to retain professionals of the caliber required to handle alternative dispute resolution for Justice Department litigated matters.  Total FY 2005 current services for this initiative are $1,000,000.
