MOTION TO UNSEAL

COMES NOW the United States of America by its attorneys, Dana J. Boente, United States Attorney for the Eastern District of Virginia, and Kimberly A. Justice, Special Assistant United States Attorney, and moves this Honorable Court for an Order unsealing all documents filed in the above-captioned action. The defendant has been arrested. Therefore, the need for keeping this matter under seal no longer exists.

Nevertheless, because the Affidavit in Support of Criminal Complaint and Arrest Warrant, filed on June 16, 2009, contains references to uncharged co-conspirators, the United States also moves this Honorable Court for an Order directing that the attached redacted Affidavit in Support of Criminal Complaint and Arrest Warrant be substituted for the original affidavit.

WHEREFORE, the government requests that this Motion, the accompanying Order and all other documents filed in this matter be unsealed and that the attached redacted Affidavit in Support of Criminal Complaint and Arrest Warrant be substituted for the original.
