The decision tree represents whether a court will accept or reject a single entity defense. There are two steps to the tree. The first is if the candidate satisfies economic unity, in which case the court will accept the defense and the matter is decided. If not, the second test of whether the parties' contribute complementary inputs is invoked. If neither test is satisfied, the court will reject the single entity defense.
