As of April 30,2003, the Department of Justice had authorized the retention of 54 private law firms for the purpose of representing 80 present and former officials and employees of the Departments of Interior, Treasury, and Justice in connection with this litigation. As of that date, payments in the amount of $3,737,945 had been made to private counsel. Payments to private counsel are made according to a fee schedule which sets forth maximum allowable rates. Prior to May 1, 2002, the schedule of maximum allowable rates was $125 - lawyer with more than 5 years practicing experience; $100 - lawyer with 3 - 5 years practicing experience; $ 83 - lawyer with 0 - 3 years practicing experience; $ 49 - paralegal or legal assistant. As of May 1, 2002, the schedule amount of maximum allowable rates was established as follows: $200 - lawyer with more than 5 years practicing experience; $160 - lawyer with 3 - 5 years practicing experience; $133 - lawyer with 0 - 3 years practicing experience; $ 78 - paralegal or legal assistant (or equivalent).
