No. 2665), the Court, over Defendants' objection, directed Defendants to disclose "all funds that defendants have used to pay private attorneys for fees and costs incurred with the present litigation for representing employees or former employees for the Department of the Interior through July 2004," to include "the hourly rates of each individual attorney who performed any work" and "the total number of hours billed by that individual attorney." As of July 2004, the Defendants – the Department of the Interior and the Department of the Treasury – have not used any funds to pay private attorneys for fees and costs incurred in connection with the present litigation for representing employees or former employees of the Department of the Interior.1 The Department of Justice, however, has paid private counsel fees and costs in connection with this litigation, pursuant to guidelines set forth at 28 C.F.R. §§ 50.15 - .16, which authorize representation of federal officials in their individual capacity in legal matters relating to conduct performed within the scope of their employment. 1/ Amounts previously reported to the Court were amounts paid by the Department of Justice. Information regarding payments by the Department of Justice to private counsel representing employees and former employees of the Department of the Interior in connection with this litigation is provided in Exhibit 1 (attached), and includes the name of the individual(s) represented, the hourly rates of each individual attorney, the total number of hours billed by each attorney, total paralegal hours billed, total costs, and total dollar amounts, through July 2004. The dollar amounts listed represent the total dollar amounts paid and should not be interpreted to represent either the timing of particular work performed or timing of particular billings by an attorney or firm.
