United States v. Almanza, et al., Cr. No. 98-CR-55S (D. Colo.)

1/01 Update:

On October 3 and October 11, 2000, respectively, Darin D. Asay and Wendy E. Almanza entered guilty pleas in United States v. Almanza, et al., 98 Cr-55-S. Defendants each pleaded guilty to three counts of mail fraud in connection with a scheme to defraud pharmaceutical manufacturers. All known victims of the scheme have been notified. Pursuant to plea agreements reached with the defendants, restitution may be available. Any restitution award must be made by the Court, however. If the Court does award restitution, the award will be part of defendants' sentencings.

6/01 Update:

On February 6, 2001, Darin Asay was sentenced to 78 months imprisonment. On February 23, 2001, Wendy Almanza was sentenced to 37 months imprisonment. Both were sentenced to pay restitution to 17 identified drug manufacturers. The exact amount of restitution has not yet been determined.

6/02 Update:

Internal Revenue Service overseeing distribution of restitution monies to 17 drug manufacturers approved in court Order dated 3/4/02, D. CO, Dkt. No. Civ. 97-S-2001.

10/02 Update:

Distribution of monies complete.
