Alfredo Susi

On May 14, 2010, the United States Court of Appeals for the Fourth Circuit, in an unpublished opinion, affirmed the convictions of Alfredo Susi, but vacated his sentence and remanded the case for resentencing. Following remand, on December 7, 2010, Susi was re-sentenced to 160 months in prison, 3 years of supervised release, and ordered to forfeit $1,885,369 and to pay $1,105,000 in restitution, jointly and severally with co-defendants and co-conspirators. Susi has already surrendered $1.05 million from a Switzerland account, which is to be applied to his restitution obligation. Subsequently, on March 21, 2012, following a second appeal taken by defendant Susi, the United States Court of Appeals for the Fourth Circuit affirmed the sentence imposed at Susi's resentencing.

Susi was convicted on April 2, 2008 after a jury trial in the U.S. District for the Western District of North Carolina of one count of conspiracy (Count 1: 18 U.S.C. § 371) and eighteen counts of wire fraud (Counts 4-7, 11-24:18 U.S.C. § 1343), with a telemarketing fraud enhancement, stemming from a massive, Costa Rica-based telemarketing fraud scheme that targeted thousands of U.S. residents, resulting in victim losses of more than $10 million. The jury also returned a special verdict of $1.885 million in forfeiture. Five counts of wire fraud (Counts 2, 3, 8, 9 & 10) were dismissed on March 31, 2008, prior to the start of the trial

Susi was originally sentenced on November 21, 2008 to 180 months' incarceration, 3 years supervised release and ordered to forfeit $1.885 million. In addition, Susi was ordered to pay $4.2 million in restitution, jointly and severally with his co-defendants and co-conspirators.

Chad Michael Schneider

Chad Michael Schneider entered a guilty plea on February 27, 2008 and was ordered detained by Judge Frank D. Whitney on April 16, 2008. Schneider was sentenced on August 18, 2008 to 51 months' incarceration, 3 years' supervised release and ordered to pay $5 million in restitution, jointly and severally with his co-defendants.

Jaime Ligator

Ligator was extradited on August 31, 2009 and pled guilty on September 1, 2009. He was sentenced on September 22, 2009 to five years in prison, to be followed by three years of supervised release, and ordered to forfeit $2.6 million. He was also ordered to pay $4.2 million in restitution, which was to be paid jointly and severally with his co-defendants.

Allen Fialkoff

Pled guilty on August 27, 2007 and was sentenced on October 28, 2008 to 28 months' incarceration and ordered to pay $5 million in restitution, jointly and severally with his co-defendants.

Sheldon Brenowitz

Pled guilty on September 26, 2007. Brenowitz was sentenced on September 26, 2008, to 51 months' incarceration, 3 years' supervised release and ordered to pay $10 million in restitution, jointly and severally with his co-defendants in related cases.
