Sexual Abuse

Sexual abuse of children and adults is typically prosecuted under state law. However, when a child is sexually abused on federal lands, such as military bases or Indian lands, the offense can also be prosecuted under federal law. For example, it is a federal crime for a person to engage in a sexual act with a minor child within specified federal territories. See 18 U.S.C. § 2243. Moreover, federal law assigns harsher penalties for those convicted of engaging in a sexual act with young children or if the offender uses force or threats, inflicts serious bodily injury or death, or kidnapping is involved. See 18 U.S.C. § 2241.
