NOV 25 1992 The Honorable Dan Glickman Member, U. S. House of Representatives 401 N. Market Street, Room 134 Wichita, Kansas 67202 Attention: Janet Anderson Dear Congressman Glickman: This letter responds to your inquiry on behalf of (b)(6) XX concerning the regulatory requirements of the Americans with Disabilities Act for curb side locations for accessible parking spaces. The ADA authorizes the Department of Justice to provide technical assistance to individuals and entities with rights or obligations under the Act. This letter provides informal guidance to assist your constituent in understanding the ADA accessibility standards. However, this technical assistance does not constitute a legal interpretation of the statute and it is not binding on the Department. The ADA Accessibility Guidelines in section 4.6.2 (page 35631 of the enclosed Federal Register document) do require that accessible parking spaces serving a particular building be located on the shortest accessible route of travel to an accessible entrance. In some instances, local fire engine access requirements prohibit parking immediately adjacent to a building. If such is the case, a marked crossing may be used as part of the accessible route to the entrance. I hope this information will be helpful to your constituent. Sincerely, John R. Dunne Assistant Attorney General Civil Rights Division Enclosure cc: Records, Chrono, Wodatch, McDowney, Magagna, Harland, Udd:Harland:glickman.cong.(b)(6) 01-01758
