APR 6 -- LOUISVILLE, KY - Acting U.S. Attorney Candace G. Hill of the Western District of Kentucky announced today that a federal grand jury in Louisville returned an indictment against Timothy Gavin, age 18, of Highland Park, Michigan, and Catherine Hillerich, age 22, of Louisville, Kentucky, on charges of possessing with the intent to distribute a quantity of 80 milligram Oxycontin pills. The Indictment alleges that on March 12, 2009, Gavin and Hillerich possessed with the intent to distribute approximately 250 Oxycontin pills. Oxycontin has the potential to be highly addictive when used for non-medical purposes, and is a Schedule II controlled substance.

In the event of a conviction, the maximum potential penalties are 20 years in federal prison, a $1,000,000 fine, and supervised release for a period of 3 years.

The case is being prosecuted by Assistant United States Attorney David Weiser, and it was investigated by the Louisville Metro Police Department and the U.S. Drug Enforcement Administration (DEA).

Both defendants are scheduled to appear for arraignment before the United States Magistrate Judge on April 21, 2009, at 9:30 a.m., in Louisville, Kentucky.
