Once the Supreme Court established the ground rules governing the scope of the waiver of sovereign immunity under the McCarran Amendment, the stage was set for the large scale adjudication of the United States’ water rights, whether arising under federal or state law.  Faced with this monumental task, the state courts were soon called upon to begin determining the United States’ federal reserved water rights.
