The Executive Office for Immigration Review Announces a New Voluntary Form

The Executive Office for Immigration Review (EOIR) announces a significant improvement in the process for applying for accreditation under 8 C.F.R. § 1292.2. Effective immediately, applications for accreditation may be submitted using a new Form EOIR-31A, Request by Organization for Accreditation of Non-Attorney Representative. The new voluntary Form EOIR-31A makes it easier for an organization to submit a complete application for accreditation and for the Board of Immigration Appeals (BIA) to review an individual’s credentials for eligibility and fitness to participate in the Recognition and Accreditation Program (Program). The new form provides organizations with clear instructions and incorporates a user-friendly format that improves efficiency for both EOIR and its customers. It also helps the BIA assess whether the organization and its representative will be true to the mission of the Program – providing indigent and low income aliens with capable, low-cost representation. Please note that, although there is now a form to apply for accreditation, the eligibility requirements for accreditation have not changed. The Executive Office for Immigration Review (EOIR) is an agency within the Department of Justice. Under delegated authority from the Attorney General, immigration judges and the Board of Immigration Appeals interpret and adjudicate immigration cases according to United States immigration laws. EOIR’s immigration judges conduct administrative court proceedings in immigration courts located throughout the nation. They determine whether foreign-born individuals—whom the Department of Homeland Security charges with violating immigration law—should be ordered removed from the United States or should be granted relief from removal and be permitted to remain in this country. The Board of Immigration Appeals primarily reviews appeals of decisions by immigration judges. EOIR’s Office of the Chief Administrative Hearing Officer adjudicates immigration-related employment cases. EOIR is committed to ensuring fairness in all of the cases it adjudicates.
