NOTICE TO RESPONDENT REGARDING PENALTIES FOR FAILURE TO REPORT FOR REMOVAL AND DEPORTATION FROM THE UNITED STATES

 

 

THE RESPONDENT MUST TAKE NOTICE THAT, since the respondent is now subject to a final order of removal, having been found deportable under any of the classes described in section 237(a), a respondent who-

 

Willfully fails or refuses to depart the United States within a period of 90 days from the date of the final order of removal under administrative process or, if judicial review is had, then from the date of the final order of the court,

 

Willfully fails or refuses to make timely application in good faith for travel or other documents necessary to the respondent’s departure,

 

Connives or conspires, or takes any other action, designed to prevent or hamper or with the purpose of preventing or hampering the respondent’s departure, or

 

Willfully fails or refuses to appear in person for removal at the time and place required by the Attorney General pursuant to such order,

 

Shall be fined under Title 18 of the United States Code, or imprisoned not more than four years, or ten years if the respondent is a member of any classes described in paragraph:

 

Section 237(a)(1)(E) relating to alien smuggling;

 

Section 237(a)(2) relating to criminal offenses;

 

Section 237(a)(3) relating to failure to register and falsification of documents;

 

Section 237(a)(4) with regard to security and related grounds.

 

Further, that the respondent may be subject to both a fine and a term of imprisonment. In addition, failure to depart, make timely application for travel documents, appear in person for removal and deportation, or conspire or take any action to prevent or hamper the respondent’s departure shall subject the respondent to pay a civil penalty of not more than $500.00 for each day the alien is in violation of these requirements.

 

This Notice was given orally to the respondent on this date and a copy furnished to him or her.
