1805. Elements Of The Offense Of Escape From Custody -- Attempt

In order to establish an "attempt" to escape under this section, the government must prove an intent to escape coupled with an overt act in the accomplishment thereof, United States v. McPherson, 436 F.2d 1066, 1067 (5th Cir.), cert. denied, 403 U.S. 997 (1971). See also Shockley v. United States, 166 F.2d 704 (9th Cir.), cert. denied, 334 U.S. 850 (1948); and Giles v. United States, 157 F.2d 588 (9th Cir. 1946), cert. denied, 331 U.S. 813 (1947).
