2/23/2021 – Fata filed a “Motion for Reconsideration of Farid Fata’s Motion for Sentence Reduction Pursuant to 18 USC 3582(c)(1)(A).”   The Court ordered the Government to file a response to Fata’s motion on or before March 9, 2021.

1/28/21 - The United States Court of Appeals for the Sixth Circuit entered an Order dismissing Farid Fata’s appeal. The Order states as follows: “the government properly raised its objection to Fata’s late filing in its motion to dismiss. Because Fata did not file a timely notice of appeal, we DISMISS this appeal.”

01/06/2021 – Judge Borman entered the following Order:  “Order Responding to Sixth Circuit Remand to the District Court to Determine whether Defendant Fata can Show ‘Excusable Neglect’ or ‘Good Cause’ Warranting an Extension of Time from the Fed. R. App. P. 4(b)(a)(A) 14-Day Deadline for Filing a Notice of Appeal from the District Court’s Denial on July 10, 2020 of his Motion for Compassionate Release or a Reduction of his Sentence.” 

In the Order, Judge Borman concluded as follows: “The District Court's review of the filings on its docket, and the party’s post remand submissions, lead the Court to conclude that Defendant Fata’s Notice of Appeal in this Court was not timely pursuant to Fed. R. App. P. 4 (b)(1)(A), and that there was no valid showing of excusable neglect or good cause by Defendant warranting an extension of the appeal period.”

11/24/2020 – In July 2020, Farid Fata filed a Notice of Appeal to the United States Court of Appeals for the Sixth Circuit attempting to appeal Judge Borman’s denial of his motion, pursuant to 18 U.S.C. § 2255, alleging ineffective assistance of counsel and seeking to vacate his guilty pleas. Today, the United States Circuit Court of Appeals filed an Order Denying Fata’s Motion For a Certificate of Appealability. This Order upholds Judge Borman’s denial of Fata’s motion seeking to vacate his guilty pleas because the Court of Appeals will not hear Fata’s appeal.

Regarding Fata’s appeal from Judge Borman’s denial of his motion for Reduction of Sentence pursuant to 18 U.S.C. § 3582(C)(1)(A):   the case remains remanded to Judge Borman for the limited purpose of determining whether Fata can show excusable neglect or good cause warranting an extension of the appeal deadline to 30 days.

10/9/2020 -  On October 8, 2020, the United States 6th Circuit Court of Appeals filed an Order regarding Fata’s appeal from Judge Borman’s denial of his motion for Reduction of Sentence Pursuant to 18 U.S.C. § 3582(C)(1)(A).  In response to the government’s Motion to Dismiss Fata’s untimely appeal, the Court of Appeals ruled that Farid Fata’s motion was filed late (after the 14-day appeal deadline) but remanded the matter back to the District Court.  The case is remanded to Judge Borman for the limited purpose of determining whether Fata can show excusable neglect or good cause warranting an extension of the appeal deadline to 30 days.

Farid Fata also filed a Notice of Appeal to the United States 6th Circuit Court of Appeals of Judge Borman’s denial of Fata’s motion pursuant to 18 U.S.C. § 2255 alleging ineffective assistance of counsel and seeking to vacate his guilty pleas.  The 6th Circuit Court of Appeals has not yet decided if this appeal will be heard.

8/17/2020 –  On August 12, 2020, the United States Court of Appeals for the 6th Circuit docketed Farid Fata’s Notice of Appeal from Judge Borman’s denial of Fata’s Motion For Reduction of Sentence Pursuant to 18 U.S.C. § 3582(C)(1)(A).  On August 12, 2020, the Court of Appeals set the following briefing schedule:

The Government’s brief is due 9/28/2020

Farid Fata also filed a Notice of Appeal to the United States 6th Circuit Court of Appeals of Judge Borman’s denial of Fata’s motion pursuant to 18 U.S.C. § 2255 alleging ineffective assistance of counsel and seeking to vacate his guilty pleas.  Because Judge Borman’s Order denied Farid Fata a Certificate of Appealability, Fata’s appeal of this ruling will not proceed to briefing by the parties unless the 6th Circuit Court of Appeals decides that the appeal will be heard.

6/30/2020 -  If you are unable to cash your restitution check because of an incomplete or incorrect name/payee,  please return your check by first class mail to the United States District Court Financial Office at the address provided below.  With your check, include the following information:  (1) a note explaining how the problem with the  payee name can be resolved; (2) a current phone number; (3) a current email address and (4) a current mailing address.  Please be advised that the Court remains closed to the public so hand delivery to the Court is unavailable.  Please only use first class mail and not certified mail or any other mailing method requiring a signature as we cannot guarantee a delivery signature for your mailing.

5/27/2020 – Judge Borman entered an Order today regarding Farid Fata’s 28 U.S.C. 2255 motion which sought to vacate his guilty pleas based upon alleged ineffective assistance of his counsel.   After the evidentiary hearing in July 2019 and the Report and Recommendation entered by Magistrate Judge Grand in February 2020, Judge Borman entered today’s Order (1) Rejecting Defendant’s Objections to Magistrate Judge’s Report and Recommendation; (2)  Adopting the Magistrate Judge’s Report and Recommendation; (3) Denying Defendant’s Motion Pursuant to 28 U.S.C. 2255 to Vacate, Set Aside, or Correct Sentence;  and (4)  Denying a Certificate of Appealability. 

Please note that Farid Fata’s recent motion for a “Reduction in Sentence” based upon the COVID-19 virus is still pending.   Pursuant to a Court Order, defense counsel’s reply brief is now due on or before June 2, 2020.

5/19/2020 - The Government filed with the Court  “United States’ Combined Response And Brief Opposing The Defendant’s Motion For Reduction Of Sentence Pursuant to 18 U.S.C. 3582(C)(1)(A)”.   A reply by the defense, if any, must be filed by May 26, 2020.

5/7/20: Pursuant to the Crime Victims’ Rights Act, 18 U.S.C. 3771(a)(4), a crime victim has the right to be reasonably heard regarding any proceeding in the district court where the defendant seeks release.  If you are a victim in this case or your deceased family member was a victim, you have the opportunity to provide a written statement to the court regarding Farid Fata’s request for early release. 

Please Note:  All submissions must be submitted via e-mail to the Victim Witness Coordinator at the U.S. Attorney’s Office for the Eastern District of Michigan:  sandy.palazzolo@usdoj.gov.*  Because of the due date of the government’s response to the request for release, submissions MUST be received before 5:00 p.m. on Wednesday, May 13, 2020.   Given the nature of these proceedings, this is a firm deadline.  Written submissions from victims will be provided to Judge Borman for consideration.   Please be advised that the government will oppose Fata’s request for early release.

5/7/2020 – On May 5, 2020, Farid Fata filed a Motion For Reduction Of Sentence Pursuant to 18 U.S.C. 3582(c)(1)(A).   On May 6, the Court ordered that the Government shall file its response on or before May 19, 2020.  The Court further ordered that the Defendant’s reply, if any, must be filed on or before May 26, 2020.

2/7/2020 – Magistrate Judge Grand filed a “Report And Recommendation To Deny Defendant’s Motion Under 28 U.S.C. 2255 To Vacate, Set Aside, Or Correct Sentence.”    Please note the next stage of the 2255 procedure at page 39 of the Report:   “Within 14 days after being served with a copy of this Report and Recommendation and Order, any party may  . . . file specific written objections to the proposed findings and recommendations . . .”   Any additional rulings by the Court regarding the 2255 Motion will be posted to this webpage.

11/25/2019 - In furtherance of the restitution process, we are continuing to liquidate assets, receive assets, and move assets to the Clerk of the Court in the criminal federal case of United States v. 7/26/2019 – In furtherance of the restitution process, the following documents were filed with the Court on July 25, 2019, by the U.S. Attorney’s Office.  These filings followed the Oakland County Circuit Court Order entered on July 17, 2019, which ordered the deposit of various liquid assets to the Clerk of the Court in the criminal federal case of United States v. 4/2/2019 – Judge Borman entered an “Order Determining Restitution and Approving Final Victim List” and an Amended Judgment that includes the restitution to be paid.  Distributions to victims will begin when a payment process is established, and the process is detailed in a further Order of the Court.    We will continue to update this webpage with any further developments.

3/25/19:   The Government filed with the Court a “Motion for Determination of Restitution and For Court Approval of the United States Final Victim List by United States of America as to Farid Fata.”   The Motion (1) includes an update on the restitution process; (2) requests that the Court order the specific amount of restitution due from Farid Fata; and (3) requests that the Court approve the final victim list to be used by the Clerk of the Court to pay restitution to the victims in this case.  We encourage victims to read the entire Motion for more specific details.   If you have questions, after reading the Motion, please contact Sandy Palazzolo at 313-226-9633.  Please note that the Motion does not include a specific date when payments will begin.

3/20/2019:  Magistrate Judge David Grand entered an “Order Setting Evidentiary Hearing On Petitioner’s Motion Under 28 U.S.C. 2255 To Vacate, Set Aside, Or Correct Sentence.”    Please note that restitution issues will not be addressed at this hearing. 

The Evidentiary Hearing will take place on July 30, 2019, 10:00 a.m. in United States District Court, 200 East Liberty Street, Ann Arbor, MI.   For anyone who plans on attending, please contact Sandy Palazzolo at 313-226-9633 to confirm the date and time, as court hearing frequently change.   Updates will also be posted to this web page.

2/14/2019 –  The Honorable Paul D. Borman issued an Order extending the restitution deadline to March 29, 2019.  The Order enables the Court to continue its review of all of the Reports and Recommendations that have been issued by United States Magistrate Judge David Grand.  As stated in the 01/24/2019 posting, Magistrate Judge Grand has completed the process of issuing a Report and Recommendation regarding each Request for Review.  The United States and the Court are continuing to work towards the finalization of the amount of restitution that is owed to each individual patient, patient estate, insurance company, and governmental agency.  No hearing has been set by the Court.  If a hearing is scheduled, the date and time will be posted to this web page.   Please note that the March 29, 2019 date is not the date for the distribution of restitution funds.   


01/24/2019 - United States Magistrate Judge David R. Grand has completed the process of issuing a Report and Recommendation for each Request for Review.  The Honorable Paul D. Borman will continue to review all of the Reports and Recommendations that have been issued.  The United States and the Court will continue to work towards the finalization of the amount of restitution that is owed to each individual patient, patient estate, insurance company and governmental agency.   The Court has previously identified February 25, 2019, as the next status date.  At this time, a hearing on the status of restitution has not been set by the Court.   At this time, we do not have an anticipated date for the distribution of any funds towards restitution.


11/26/2018 - Because the process for evaluating the Requests for Review filed by victims and family members of victims is not yet complete, the Honorable Paul D. Borman entered an Order extending the restitution deadline from November 26, 2018 to February 25, 2019.  The Order explains that the government has reviewed each Request for Review and has responded to those Requests and that United States Magistrate Judge David R. Grand continues to undertake the process of issuing a Report and Recommendation for each Request for Review. This is a time-intensive process that requires Magistrate Judge Grand to conduct a detailed review of the voluminous data accompanying many of the Claims in order to prepare a comprehensive Report and Recommendation for each Request for Review. Please note that the February 25, 2019 date is not the date that restitution money will be distributed.  The new date simply permits the restitution process to continue until it is complete.

9/6/2018 - Due to the complexity of the claim review process and in order to ensure that every claim of every victim and family member is thoroughly and fairly reviewed, the process remains ongoing.  However, the process is substantially closer to its conclusion.   We acknowledge and appreciate your patience as we continue toward its conclusion.  We will continue to update this webpage with any further developments.


5/22/2018 - Because the process for evaluating the Requests for Review filed by victims and family members of victims is not yet complete, the Honorable Paul D. Borman entered an Order extending the restitution deadline from May 22, 2018 to November 26, 2018.  Please note that the November 26, 2018 date is not the date that restitution money will be distributed.  The new date simply permits the restitution process to continue until it is complete.

4/13/18 - Please be advised that a substantial number of victims and family members of victims filed Requests for Review of the Facilitator’s recommendation regarding eligibility for restitution.  The Department of Justice and the Court are still in the process of carefully reviewing all of the Requests for Review.  Magistrate Judge David Grand will be making a recommendation to Judge Borman regarding the outcome of each Request for Review.  When the review process is complete and Magistrate Judge Grand has completed his recommendations to Judge Borman, we will update this webpage. Please be aware that we are not yet able to predict the timing of payments.  Checks cannot be dispersed until after the review process is complete and a Judgment is entered by the Court regarding all victims.


02/12/2018 -  Because the Facilitator has issued her Final Recommendations and Requests  for Review are now being reviewed by the Court, the Facilitator will be closing the toll free line  at 5:00 p.m. on February 16, 2018.  Any questions after February 16 should be directed to Sandy Palazzolo, the Victim Witness Coordinator at the U.S. Attorney’s Office for the E.D. of Michigan, at 313-226-9633.  In addition, mail should no longer be sent to the P.O. Box of the Facilitator after February 16, 2018.  All mail and documents should also be directed to Ms. Palazzolo as follows:

11/22/2017 – Judge Borman entered an " Order (1) Continuing Restitution Process; and (2) Precluding Further Submission/Processing of Late Filed Claims for Restitution and Late Requests for Reconsideration of Denied Claims.   Please note that the Order addresses late claim submissions and late reconsideration requests.  First, “Late claims and late reconsideration requests that pre-dated Ms. Roth’s November 7, 2017 Final Report shall be processed and paid in the same manner as timely filed claims.” Second, “No further late claims or late reconsideration requests will be accepted for processing by the Claims Facilitator or the Court.”  The Court stated that no further claims or reconsideration requests will be accepted because “granting any further exceptions . . . would necessarily disrupt the established December 11, 2017 deadline for filing appeals to this Court and would be fundamentally unfair to those claimants who filed timely claims and timely requests for reconsideration.”

11/14/2017 – The Government filed with the Court a “Notice of Report on Restitution” and the “Claims Facilitator’s Final Report to the Department of Justice Regarding the Restitution Process: Steps Taken, Remaining Steps, Statistics, Issues of Note, Questions for the Court, and Transmission of Final Recommendations.”  The Facilitator’s report will be addressed at the Restitution Status Hearing currently scheduled for Tuesday, November 21, 2017 at 11:00 a.m. in the courtroom of the Honorable Paul D. Borman, room 737.

11/8/2017 – The Honorable Paul D. Borman changed the date and time of the Restitution Report Hearing.  The hearing will now take place on  Tuesday, November 21, 2017 at 11:00 a.m., Theodore Levin United States District Courthouse, 231 W. Lafayette, Courtroom 737, Detroit, MI 48226.   If you plan on attending and have not already done so, please contact Sandy Palazzolo at 313-226-9633 or sandy.palazzolo@usdoj.gov.  Please refer to the posting below for information relating to parking and admittance into the courthouse. 

 


10/23/2017 -  A Restitution Report Hearing will take place before Judge Borman at 3:00 p.m. on November 17, 2017, in courtroom 737 of the Theodore Levin United States District Courthouse.    The purpose of this hearing will be to update the Court on the progress of the claims process and to provide the Court with recommendations of the Facilitator regarding the claims filed.  The Facilitator, Ms. Randi Ilyse Roth, will be present at the hearing and will address the Court. Prior to the hearing, the Facilitator’s recommendation in each case will be sent directly to the Claimant’s address-of-record and a listing of recommendations in individual cases will be filed with the Court under seal.  The hearing will not include final conclusions with regard to any specific claims.  There will be a process by which individual claimants can make a request for Court review of any mistakes they may find in the Facilitator’s recommendation in their case.  It is anticipated that this status hearing will conclude Ms. Roth’s involvement as her final report will be presented to the Court.

While it is not necessary to advise Ms. Palazzolo of your attendance at this proceeding as the proceedings are open to the public, it is requested as a courtesy to ensure adequate seating accommodations for all who wish to attend. The courtroom has limited seating. If the response for attendance exceeds the number of seats available in the courtroom, overflow seating accommodations will be made. Please be advised that contacting Ms. Palazzolo does not ensure a seat in courtroom 737. Seating in courtroom 737 will be on a first come basis. Once all designated seating is full in courtroom 737, attendees will be directed to view the proceedings from an overflow room (if an overflow room is necessary). As a reminder:

  • No disruptive conversations or gestures are permitted in the Courtroom. Failure to comply with these rules will result in removal from the Courtroom.
  • Courtroom proceedings may not be recorded or photographed.
  • Parking is available in various lots and structures surrounding the courthouse.  Cost for parking ranges from $10.00/day to 30.00/day.  At this time, it does not appear that there are any events scheduled for the November 17th hearing date.   Any updates about potential parking issues will be posted to this website.
  • Handicap entry to the Courthouse is available at the Fort Street entrance.  Parking is not provided by the Courthouse or by the United States Attorney’s Office.  Therefore, handicap parking cannot be arranged.  Individuals requiring assistance should be accompanied by someone.
  • Security screening will be required to gain entry into the Courthouse.   Photo identification is required.
  • Phones, recording devices, cameras, laptops, and/or other electronic devices are not permitted in the Courthouse.  There are no lockers or safe areas in which to leave these items.  If you forget and have one of these items in your possession, you will be required to return it to your vehicle.
  • Knives, weapons, scissors, or any other sharp object which could be used as a weapon are prohibited.
  • Proper credentials/identification are required for service animals.
  • Please arrive early to allow sufficient time to pass through security.
  • Food and beverages are NOT permitted in Courtroom 737 or the designated overflow room, if applicable.
  • Victims are not permitted to address the court at this hearing.

7/18/17 - Judge Paul D. Borman enters an Order adjourning the date of the Restitution Hearing from August 16, 2017 to November 17, 2017 at 3:00pm. The Order states that, “due to the number of claims and the complexity of the process, the claims facilitator will not have her provisional decision and her reconsideration finalized before the August 16, 2017 date.” The Order further describes the review process by the Facilitator, the review process by the Court, and the information to be covered at the November 17 hearing.

1/27/2017 – Judge Borman entered an "Order Setting Restitution Report Hearing at 10:00 a.m. on August 16, 2017."  The Order summarizes the January 17, 2017 hearing and sets the next restitution report hearing date for Thursday, August 16, 2017 at 10:00 a.m. in courtroom 737 of the Theodore Levin United States District Courthouse.   Any updates regarding the August hearing and the restitution process will be posted to this webpage and www.fataclaims.com (archived).

1/12/2017 – The Government filed with the Court a “Notice of Report on Restitution” and the “Claims Facilitator’s Report to the Department of Justice Regarding the Restitution Process: Progress Made to Date, Statistics and Additional Steps Necessary to Complete the Claims Process.” The Facilitator’s report will be addressed at the Restitution Status Hearing currently scheduled for Tuesday, January 17, 2017 at 2:00 p.m. in the courtroom of the Honorable Paul D. 12/15/2016 – Judge Paul D. Borman issued an Order explaining the purpose of the Restitution Status Hearing.   This hearing is currently scheduled for January 17, 2017 at 2:00 p.m. in courtroom 737.   The Order explains that this hearing will relate solely to the progress of the previously-approved plan of restitution.  The Government will report on the progress of the plan.  The hearing will not involve or discuss Farid Fata’s conviction or sentence.  Defendant Fata will be present at this hearing.  For a copy of the Order, please click HERE.

As a reminder:

  • No disruptive conversations or gestures are permitted in the Courtroom. Failure to comply with these rules will result in removal from the Courtroom.

  • Security screening will be required to gain entry into the Courthouse.   Photo identification is required.
  • Phones, recording devices, cameras, laptops, and/or other electronic devices are not permitted in the Courthouse.  There are no lockers or safe areas in which to leave these items.  If you forget and have one of these items in your possession, you will be required to return it to your vehicle.
  • Knives, weapons, scissors, or any other sharp object which could be used as a weapon are prohibited.
  • Proper credentials/identification are required for service animals.
  • Please arrive early to allow sufficient time to pass through security.
  • Food and beverages are NOT permitted in Courtroom 737 or the designated overflow room, if applicable.

9/26/2016 -- Judge Paul D. Borman enters an Order Extending the Restitution Filing Deadline.  The Order states that, “due to the complexity and nature of the claims being submitted and the necessity that former patients obtain medical and financial documentation supporting these claims, additional time is required to ensure that the maximum number of eligible claims will be submitted by former patients. Accordingly, and to ensure that former patients have sufficient time and ability to submit claims for restitution, the Court hereby extends the deadline for filing such claims from October 5, 2016 to November 14, 2016.”

The Order also changes the date of the Restitution Hearing from November 1, 2016 to January 17, 2017 at 2:oopm.

6/8/2016 - Beginning on June 9, the Claim Form for the restitution process in the criminal case of United States v. Farid Fata will be available on www.fataclaims.com

Claim Forms will be mailed to individuals who received a "Victim Notification Letter" from the U.S. Attorney's Office.  You may use either the version mailed to you or the version available on www.fataclaims.com as the Claim Form is exactly the same.

For those who did not receive a "Victim Notification Letter" and do not have access either to a computer and/or to a printer, please contact 1-877-202-3282 (on or after June 9) and request that a Claim Form be mailed to you.

The Claim Form will be accompanied by a letter from the United States v. Fata Facilitator, Randi Ilyse Roth, and detailed instructions.  Please review the instructions carefully. 

There are important dates in the letter from Ms. Roth, in the instructions, and in the Claim Form.  Please review the letter, the instructions, and the Claim Form as soon as possible, because there will be no deadline extensions allowed.

To assist you in answering questions you may have about submitting a claim for restitution, the following resources will be available:

5/25/2016 – The U.S. Court of Appeals for the Sixth Circuit has affirmed Farid Fata’s convictions and sentence.  Therefore, the sentence originally imposed by Judge Borman will remain as Fata’s sentence.

4/25/2016 – The U.S. Court of Appeals for the Sixth Circuit will hear the oral arguments in this case on April 28, 2016 in Courtroom number 842.  Please be advised that these proceedings will take place at the U.S. Court of Appeals for the Sixth Circuit, Potter Stewart U.S. Courthouse, 100 East Fifth Street, Cincinnati, Ohio 45202.  There is no specific time scheduled for the oral argument to begin in the U.S. v. Fata case.  Court will begin at 9:00 a.m.  with the oral argument for U.S. v. 3/10/2016 – The United States Court of Appeals for the Sixth Circuit has scheduled an oral argument regarding the appeal filed by Farid Fata.   The argument will be Thursday, April 28, 2016 at 9:00 a.m.  Please note that the oral  arguments by the attorneys will not be in Detroit.  They will take place at the federal courthouse in Cincinnati, Ohio, which is located at 100 East Fifth Street.  A courtroom has not yet been assigned.  Further information and/or updates will be posted on this webpage prior to April 28.

1/29/2016 - Restitution Process Update: The restitution process involving assets seized from Farid Fata is ongoing. The government is in the process of liquidating Fata’s assets, a necessary step before any funds can be made available. The government’s goals are to maximize the amount of money available and to create a fair and equitable process by which patients and family members of former patients can apply for available funds.  Please be aware that no restitution application form has been distributed by the federal government.  If you have seen a restitution form, it is not the form that will be used in this federal case.  When the process is finalized and the restitution application is available, it will be by court order from Judge Borman and further information will be posted on this web page, including the process by which applications can be completed and submitted for review.

7/1/2015 - The Court has established the following rule for decorum inside the United States District Courthouse: The Court respectfully requests that individuals do not wear items (pins, t-shirts, etc.) or openly carry items (photos, banners, signs, etc.) depicting images of former patients or containing comments regarding the case or the defendant while inside the United States District Courthouse. Sentencing proceedings will begin on Monday, July 6, 2015, at 9:00 a.m.  The proceedings will continue every business day thereafter between the hours of 9:00 a.m. and 1:30 p.m. until the imposition of the sentence. The exact date and time of the imposition of the sentence is unknown at this time.

After requesting seats from Ms. Palazzolo, the available seats in Courtroom 737 for each day of the proceedings will be determined by a lottery system prior to July 6, because the courtroom is not large enough to accommodate all those who wish to attend.  Former patients and their family members will be notified prior to July 6 if they have been randomly selected to sit in Courtroom 737 and on which date(s) they have been randomly selected to sit in Courtroom 737.  If you are randomly selected to sit in Courtroom 737, one seat will be reserved for you and one seat will be reserved for one guest to accompany you. Seating will be located in designated benches behind the government’s table.

Additional seats will be available in Room 115 and Courtroom 712 of the Courthouse each day.  A live audio and video feed of all proceedings will be provided in Room 115 and Courtroom 712.   The seats provided in Room 115 and Courtroom 712 are available for those who wish to view the proceedings but are not randomly selected to sit in Courtroom 737 and for those patients and family members who do not wish to request Courtroom 737 seating.  Seating in Room 115 and Courtroom 712 will be on a first come, first served basis.  The general public and the media will also have access to Room 115 and Courtroom 712 seating.   Interviews by the media will not be permitted in any location inside the Courthouse or any area which prevents ingress to and egress from the Courthouse.  Court Security will be present in Room 115 and Courtroom 712 to maintain the same decorum as set forth for Courtroom 737.

Courtroom Decorum

Courtroom 737 will be open fifteen (15) minutes before each court session.  To minimize disruptions in the Courtroom, all media personnel and spectators with reserved seats should be seated five (5) minutes before each session and should remain seated throughout the proceedings until a court recess.  Only counsel and an assistant will be permitted to enter and exit the Courtroom once proceedings have commenced.

No disruptive conversations or gestures are permitted in the Courtroom. Failure to comply with these rules will result in removal from the Courtroom.

No one viewing these proceedings in this Courthouse may bring into the Courthouse any cameras, electronic recording, or communication devices of any kind.

To assist with overall security and general public access to the Courthouse, the Court has designated the usual outside area for media use throughout the sentencing proceedings: the north side of Lafayette, across from the Courthouse.  This is the only area where interviews, still pictures, and film coverage can be activated and conducted.

No member of the media shall attempt to secure an interview or conduct an interview in the Courthouse or in any area which prevents ingress to and egress from the Courthouse.

Public gatherings are allowed on the public sidewalks surrounding the Courthouse. At no time should public access to the Courthouse be restricted by media covering events.

1/20/2015 - Judge Paul D. 9/16/2014 HEARING ADJOURNED Dr. Farid Fata entered a plea of guilty to the following charges:   Thirteen counts of Health Care Fraud;  One count of Conspiracy to Pay and Receive Kickbacks; Two counts of Money Laundering.  Sentencing is currently scheduled to begin on February 23, 2015  at 10:00 a.m.

9/09/2014 - Judge Paul D. Borman scheduled a hearing to address the defendant’s “Motion to Suppress Evidence.”   The hearing will take place on Tuesday, September 16, 2014 at 3:00 p.m., in courtroom 737.


9/8/2014 – Tuesday, September 16, 2014, 3:00 p.m. Final Pretrial Conference/Final Plea Date. During this Court hearing, various trial issues may be discussed. It is also the last date and time that the defendant can plead guilty in Court under a plea agreement.


6/16/2014 - The Honorable Paul D. Borman issues a Third Amended Scheduling Order   
A final pretrial conference is scheduled for September 16, 2014 at 3:00 p.m.  
The Court changes the trial date from October 21, 2014 to October 14, 2014      
Jury selection will begin on October 14, 2014at 9:30 a.m.
Starting on October 15, 2014, the hours of jury selection will be 9:00 a.m. to 4:00 p.m. until a jury is selected. 
Once a jury is selected, trial will begin.  Trial hours will be 9:00 a.m.to 1:00 p.m   
Near the conclusion of the trial and during closing arguments and deliberations, the trial hours will change to 9:00 a.m. to 4:00 p.m.  
All above referenced court proceedings will take place in the courtroom of the Honorable Paul D. Borman, courtroom 737.


6/11/2014 - The Honorable Paul D. Borman issues an order adjourning the trial date.  Trial is now scheduled to begin on October 21, 2014 at 9:00 a.m. in courtroom 737.

6/10/2014 - Defense counsel files a Notice of Withdrawal of Motion for Appointment of Counsel.  As a result, the hearing currently scheduled for June 12, 2014, will be cancelled.

6/3/2014 -  The defense requested additional time to prepare for trial.  Following this request, the Court moved the trial date to October 14, 2014, 9:00 a.m. in the courtroom of the Honorable Paul D. Borman, courtroom 737.


6/3/2014 -  CANCELLED Judge Paul D. Borman has scheduled a motion hearing to address the defendant’s “Motion to Appoint Counsel.”  The hearing will take place on June 12, 2014 at 1:00 p.m., in courtroom 737.


6/3/2014 – Judge Paul D. Borman denied the defendant’s Motion for Change of Venue.

3/3/2014 - Judge Paul D. Borman has scheduled a subpoena procedure hearing to take place on March 10, 2014 at 2:00 p.m.


2/4/2014 – Dr. Farid Fata is arraigned on the fourth superseding indictment.  Judge Borman confirmed the trial will begin on August 12, 2014, and will be in session Monday through Friday  from 9:00 a.m. – 1:00 p.m.  Any updates or newly scheduled court events will be reflected on this web site and the victim information line.


1-23-14 – The United States Court of Appeals for the Sixth Circuit enters an order affirming Judge Borman's order detaining Dr. Farid Fata pending trial.

1/15/2014 - A 4th Superseding Indictment is filed against Dr. Farid Fata. This new indictment supersedes the 1st, 2nd and 3rd  Superseding Indictments. The 4th Superseding Indictment now charges Dr. Fata with the following federal criminal violations:

Counts 1 through 19 - Health Care Fraud

Count 20 - Conspiracy to Pay and Receive Kickbacks

Count 21 - Unlawful Procurement of Naturalization

12-16-13 – Judge Paul D. Borman grants defense counsel’s request to adjourn the trial date. A new trial date has been scheduled for April 8, 2014, 9:00 a.m. A status conference has been scheduled to take place on February 4, 2014 at 10:00 a.m.


12/2/2013 – Dr. Farid Fata is arraigned on the second superseding indictment. Another status conference has been scheduled for Monday, December 16, 2013 at 11:00 a.m. The date of the conference may change to Thursday, December 12 or Friday, December 13. Any changes will be reflected on this website and on the information line.


11/27/13 - Arraignment on the Second Superseding Indictment and Status Conference are scheduled to take place on 12/2/13 at 3:00 pm in the courtroom of the Honorable Paul D. Borman


11/20/2013 - The U.S. Attorney’s Office files a 2nd Superseding Indictment adding additional counts.  This new indictment supersedes the 1st Superseding Indictment.  The new indictment now charges Dr. Fata with the following federal criminal violations:
Counts 1 through 17 - Health Care Fraud
Count 18 - Conspiracy to Pay and Receive Kickbacks
Count 19 - Unlawful Procurement of Naturalization

10/2/2013   Judge Borman holds a hearing to address the defendant’s motion requesting a modification of bond conditions.  An order of detention pending trial is entered by the judge for defendant Dr. Farid Fata.   Dr. Fata will remain in custody during the pendency of this case.  Judge Borman’s ruling does not signify a determination of guilt, only a determination that there is a risk of flight based on the evidence presented.


9/24/2013 -  Judge Borman schedules the date and time of the arraignment on the superseding indictment.   The arraignment will take place on October 2, 2013 at 9:30 a.m., in conjunction with the motion hearing outlined below in line item 9/20/13.    The purpose of the arraignment is to formally provide Dr. Fata with a copy of the superseding indictment outlining the new charges he is facing.  Both hearings will take place in the Courtroom of the Honorable Paul D. Borman, room 737.

9/20/2013 -  Judge Borman reschedules the time currently scheduled for the motion hearing.   Please note this hearing will now take place on  October 2, 2013 at 9:30 a.m.  The motion hearing will address the defendants request for a modification of the bond/pretrial release conditions.  This hearing will take place Courtroom of the Honorable Paul D. Borman, room 737.


9/17/2013 – The U.S. Attorney’s Office supersedes the original grand jury indictment, adding additional counts. The new indictment now charges Dr. Fata with the following federal criminal violations:

Counts 1 through 12 - Health Care Fraud
Count 13 - Conspiracy to Pay and Receive Kickbacks
Count 14 - Unlawful Procurement of Naturalization

8/21/2013 – The Honorable Paul D. Borman schedules a trial date of October 15, 2013 at 9:00 a.m.  Trial will take place in Judge Borman’s  courtroom number 737, located on the 7th floor of the United States District Court.


8/14/2013 – The U.S. Attorney’s Office obtains a grand jury indictment, charging Dr. Fata with one count of “Health Card Fraud”.

8/13/2013 – The Honorable Sean F. Cox sets bond/pretrial release for defendant Dr. Fata in the amount of $9,000,000 secured.   Unable to post bond, defendant remains in custody.


8/8/2013: Magistrate Judge David R. Grand signs a bond order for the defendant.  The government appeals Magistrate Judge Grand’s order.


8/6/2013:  Federal search warrants are executed at the offices of Dr. Farid Fata.  Dr. Fata is arrested and charged in a federal criminal complaint with Health Care Fraud.  The government requests that the court detain the defendant in the custody of the U.S. Marshal Service pending the resolution of the case.
