Anchorage, Alaska – U.S. Attorney Karen L. Loeffler, District of Alaska, announced that an Anchorage man was indicted by a federal grand jury in Anchorage for two counts of being a felon in possession of firearms.

The two-count indictment names Brian Sherrod Lewis, 35, of Anchorage, Alaska, as the sole defendant.

According to the indictment, Lewis has a felony conviction for robbery in the first degree from 1997, and was found to be in the possession of a D.C. Industries Model AK Pistol on January 23, 2009. The indictment alleges that on August 13, 2009, Lewis was found to be in the possession of one Hi-Point model CF .380 ACP caliber pistol and one Izhmash Model SAIGA .223 Remington caliber firearm.

Special Assistant United States Attorney Erin E. White, who presented the case to the grand jury, indicated that the law provides for a maximum total sentence of 10 years in prison, a fine of $250,000, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed would be based upon the seriousness of the offenses and the prior criminal history, if any, of the defendant.

Ms. Loeffler commended the Federal Bureau of Investigation and the Anchorage Police Department for the investigation leading to the successful indictment in this case. SAUSA White is a prosecutor in the U.S. Attorney’s Office funded by the Municipality of Anchorage for the purpose of prosecuting gang-related and violent crime cases.

An indictment is only a charge and is not evidence of guilt. A defendant is presumed innocent and is entitled to a fair trial at which the government must prove guilt beyond a reasonable doubt.
