Assets were forfeited in this case which are not currently available for distribution because they are either awaiting repatriation from a foreign country or are awaiting liquidation in the United States.  These assets account for most of the difference between the $2.4 million that was recently distributed to the victims and the estimated $4.1 million of total forfeited assets.  The $4.1 million figure is only an estimate and the final amount of recovery could be more or less.  While the remission process attempts to provide the maximum possible recovery after the payment of government expenses, it does not guarantee any particular rate of return to victims.  If you have any questions regarding victim restitution, you may contact the Remission Administrator at 888-293-8840.

The Treasury Department is expected to transfer the funds to the Administrator within the next few days and distribution should occur within 30 days after transfer. However, there is no specific date or deadline for distribution.

The Department of Justice Asset Forfeiture and Money Laundering Section advises: “All of the forfeited funds will be distributed to victims, less minimal administrative expenses. The Department of Justice and the Department of Treasury Forfeiture Fund are preparing to transfer approximately $2.4 million to the Claim Administrator, Gilardi & Co.. The transfer is expected to occur within the next two weeks. Distribution to verified victims of the UniDyn fraud is expected to follow within 10 business days after the transfer. Additional assets associated with the UniDyn fraud have been identified and/or forfeited, but they are not currently in United States Government custody. If and when those additional assets become available, a second distribution will be made to the victims.”
