Stockton Woman Sentenced To 15 Months For Conspiracy To Commit Tax Fraud

SACRAMENTO, Calif. – United States Attorney Benjamin B. Wagner announced that Theresa Gallindo Constancio, 45, of Stockton, was sentenced today by United States District Judge Morrison C. England Jr. to 15 months in prison to be followed by three years of supervised release for her role in a conspiracy to defraud the government with respect to false tax returns. She was also ordered to pay $8,874 in restitution to the IRS.
According to court documents, Constancio was part of a conspiracy to file fraudulent tax returns to the IRS, seeking refunds. Constancio filed a false return in her own name and recruited two other people to do the same.
In sentencing, Judge England said that the sentence was appropriate, taking into consideration the defendant’s conduct in the conspiracy. The judge also considered the defendant’s prior record, including five DUI convictions.
This case is the product of an extensive investigation by the Internal Revenue Service, Criminal Investigation. Assistant United States Attorney Samantha S. Spangler prosecuted the case.
