Modesto Building Contractor Charged with Tax Fraud

FRESNO, Calif. — United States Attorney Benjamin B. Wagner announced that yesterday a federal grand jury returned a two-count indictment charging Timothy Bernard Baum, 42, of Modesto, with filing a false tax return.
According to the indictment, in 2004 and 2005, Baum owned and operated Creative Tile, which installed tile for commercial and residential properties in the Modesto area. Baum allegedly deposited some of his business receipts into a personal bank account, and then did not inform his tax preparer about this other account. The indictment alleges that Baum failed to declare gross receipts totaling more than $275,000.
This case is the product of an extensive investigation by the Internal Revenue Service, Criminal Investigations. Assistant United States Attorney Mark J. McKeon prosecuted the case
If convicted, Baum faces a maximum statutory penalty of three years in prison and a $250,000 fine. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.
The charges are only allegations and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
