Guilty Plea in 1999 Seizure of 300 Kilograms of Cocaine

FRESNO, Calif. — United States Attorney Benjamin B. Wagner announced that David Allen Harp, 64, of Westley, pleaded guilty Monday to possession of cocaine with the intent to distribute.

According to his guilty plea, Harp admitted that on March 13, 1999, he was driving a motor home with 300 kilograms (660 lbs.) of cocaine that he intended to distribute. Harp was originally charged in state court and failed to appear. He surrendered to immigration officials in San Ysidro on November 3, 2010 and has been in custody since that time.

This case is the product of an extensive investigation by the U.S. Immigration and Customs Enforcement (ICE) Office of Homeland Security Investigations (HSI), the California Bureau of Narcotic Enforcement, and the California Highway Patrol. Assistant United States Attorney Kevin P. Rooney is prosecuting the case.

Harp is scheduled to be sentenced by United States District Judge Oliver W. Wanger on June 27, 2011. He faces a mandatory minimum sentence of 10 years in prison up to life in prison and an $8 million fine. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory sentencing factors and the Federal Sentencing Guidelines, which take into account a number of variables.
