FRESNO, Calif. — United States Attorney Benjamin B. Wagner announced that a federal grand jury returned an indictment today charging Emmanuel Martinez Ruvalcaba, 19, of Alhambra, and Rafael Alfonso Torres, 22, of Mexico, with conspiracy to distribute methamphetamine and possession of methamphetamine with the intent to distribute.

According to court documents, Ruvalcaba and Torres were in possession of over 500 grams of methamphetamine intended for distribution.

This case is the product of an investigation by the United States Drug Enforcement Administration, the California Highway Patrol, and the Merced Multi-Agency Narcotic Task Force. Assistant United States Attorney Yasin Mohammad is prosecuting the case.

If convicted, Ruvalcaba and Torres face a mandatory minimum prison term of 10 years in prison up to a maximum term of life in prison and a $10 million fine. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.

The charges are only allegations and the defendants are presumed innocent until and unless proven guilty beyond a reasonable doubt.
