SACRAMENTO, Calif.– United States Attorney Benjamin B. Wagner announced today that Gabriel Johnson, 35, of Sacramento, was convicted on Friday, July 1, 2011, of possession with intent to distribute oxycodone and marijuana. The guilty verdict was returned by a federal court jury in Sacramento after a four-day trial before United States District Judge Garland E. Burrell, Jr.

According to testimony presented at trial, Johnson possessed significant quantities of oxycodone and marijuana for sale in his midtown apartment.

This case is the product of an extensive investigation by the Sacramento Police Department and the Drug Enforcement Administration.  Assistant United States Attorneys Paul Hemesath, Michael Beckwith and Daniel McConkie prosecuted the case.

Johnson will be sentenced by Judge Burrell in approximately ten weeks.  Given his lengthy criminal history, Johnson will likely be facing a sentence of 17 years in prison.  The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.
