San Joaquin Man Indicted for Distributing Child Pornography

SACRAMENTO, Calif. — United States Attorney Benjamin B. Wagner announced that a federal grand jury returned a four-count indictment charging Wilfred Frank Luce, Jr., 48 of Stockton, with receiving and distributing child pornography.
According to the indictment, between March and July 2011, Luce distributed child pornography on two separate occasions.
This case is the product of an investigation by the Sacramento and San Jose Internet Crimes Against Children task forces (ICAC)and the San Joaquin Sheriff's Department. The Sacramento ICAC is a federally and state-funded task force managed by the Sacramento Sheriff's Department and is composed of agents from federal, state, and local agencies. It investigates online child exploitation crimes, including child pornography, enticement, and sex trafficking. Assistant United States Attorney Kyle Reardon is prosecuting the case.
If convicted, Luce faces a minimum sentence of five years in prison and up to 20 years in prison, a life term of supervised release and a $250,000 fine. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory sentencing factors and the Federal Sentencing Guidelines, which take into account a number of variables.
The charges are only allegations and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
This case was brought as part of Project Safe Childhood (PSC), a nationwide initiative by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by United States Attorneys' Offices and the Criminal Division's Child Exploitation and Obscenity Section, PSC mobilizes federal, state, and local resources to locate, apprehend, and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims.
