FRESNO, Calif. — United States Attorney Benjamin B. Wagner announced that a federal grand jury returned an indictment today charging Luis Santarosa, 22, of Fresno, with being a felon in possession of a firearm.
The indictment alleges that Santarosa was previously convicted for assault by means likely to cause great bodily injury.
If convicted, Santarosa faces a maximum sentence of 10 years in prison, a $250,000 fine, and three years of supervised release. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.
This case is the result of Project Safe Neighborhoods — a project designed to reduce illegal drugs and violent crimes with the particular focus of cracking down on gang activities. Project Safe Neighborhoods brings to bear a coordinated effort between local and federal law enforcement agencies including the Fresno Police Department, the Bureau of Alcohol, Tobacco, Firearms and Explosives, the United States Attorney's Office for the Eastern District of California, and the Fresno County District Attorney's Office. Assistant United States Attorney Yasin Mohammad is prosecuting the case.
The charges are only allegations and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
