Federal Inmate Faces Charge for Illegal Possession of a Weapon in County Jail

FRESNO, Calif. — United States Attorney Benjamin B. Wagner announced today that a federal grand jury returned an indictment charging Cesar Villa, 27, of Marysville, with possessing a weapon in prison.

            This case is the product of an investigation by the Fresno County Sheriff’s Office and the U.S. Marshals Service. Assistant United States Attorney Kimberley A. Sanchez is prosecuting the case.

            According to the indictment, on May 5, 2011, Villa possessed a weapon while incarcerated in the Fresno County Jail. According to court documents, he is being held without bail on pending federal drug trafficking charges.

            If convicted, Villa faces a maximum statutory penalty for the weapons charge of five years in prison and a $250,000 fine. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.

            The charges are only allegations and the defendant are presumed innocent until and unless proven guilty beyond a reasonable doubt.
