            FRESNO, Calif. — United States Attorney Benjamin B. Wagner announced that a federal grand jury returned an indictment today charging Glen Avilla, 45, of Oakdale, with being a felon in possession of a firearm and possessing a firearm not registered in the National Firearms Registry.

            This case is the product of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Oakdale Police Department. Assistant United States Attorney Kimberly Sanchez is prosecuting the case.

            According to the indictment, on March 15, 2011, Avilla, who had prior convictions for felony offenses, was in possession of an unregistered sawed-off shotgun. In 2002, he was convicted for possession of a destructive device, and in 2004, he was convicted for possession of ephedrine with the intent to manufacture methamphetamine.

            If convicted, Avilla faces a maximum statutory penalty of 10 years in prison and a $250,000 fine. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.

            The charges are only allegations and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
