SACRAMENTO-- United States Attorney Benjamin B. Wagner announced that a federal grand jury returned an indictment today charging Sophal Ouch, 27, of Stockton, with one count of being a felon in possession of a firearm. The indictment alleges that Ouch, who has felony convictions for car theft and possession of stolen property, was found carrying a firearm on October 30, 2011.
This case is the product of a joint investigation by the Stockton Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives. Assistant United States Attorney Jason Hitt is prosecuting the case.
The maximum statutory penalty for the violation charged in the indictment is ten years in prison. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.
The charges are only allegations and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
