San Joaquin Man Pleads Guilty to Receiving Child Pornography

SACRAMENTO, Calif. – United States Attorney Benjamin B. Wagner announced that Wilfred Luce, 48, of Stockton, California, pleaded guilty today to receipt of child pornography. The guilty plea was entered before United States District Judge Garland E. Burrell, Jr.
This case is the product of an extensive investigation by the Sacramento Internet Crimes Against Children (ICAC) Task Force, the San Jose ICAC Task Force, and the Stockton Police Department. The Sacramento ICAC is a federally and state funded task force managed by the Sacramento Sheriff’s Department comprised of agents from federal, state, and local agencies. The purpose of the Sacramento ICAC is to investigate online child exploitation crimes, including child pornography, enticement, and sex trafficking. Assistant United States Attorney Kyle Reardon is prosecuting the case.
According to the plea agreement, beginning on March 12, 2011, law enforcement identified Luce’s computer offering files of child pornography through an internet file-sharing service. On March 30, 2011 and April 10, 2011, agents connected to Luce’s computer and downloaded child pornography videos. On July 6, 2011, Sacramento ICAC detectives served a federal search warrant at Luce’s residence in Stockton, California. Running at the time of the search was an internet file-sharing program that was actively downloading child pornography. A forensic analysis of Luce’s computer and external hard drive showed that Luce had downloaded child pornography through the file-sharing network between March 12, 2011, and July 6, 2011. He then transferred some of the images of minors engaged in sexually explicit conduct that he downloaded to the external hard drive. In total, Luce downloaded 440 images and 212 videos of child pornography.
The defendant is scheduled to be sentenced by Judge Burrell on February 3, 2012. The statutory penalty for a violation of 18 U.S.C. § 2252(a)(2) is no less than five years imprisonment and up to 20 years, and a five year term of supervised release. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.
