            SACRAMENTO, Calif. — United States Attorney Benjamin B. Wagner announced that a federal grand jury returned a three-count indictment on December 1, 2011, charging Joe L. Regalado, 38, of Stockton, with trafficking in counterfeit goods and illegally possessing weapons and ammunition.

            According to the indictment, over a nearly two-year period, Regalado trafficked in goods bearing counterfeit trademarked insignia. In May 2011, despite having been convicted of a felony, he illegally possessed two firearms and ammunition. Regalado was arrested by FBI agents on December 2, 2011, and appeared today before United States Magistrate Judge Gregory G. Hollows where he entered a plea of not guilty. His next appearance in court is scheduled for January 23, 2012 before Judge William B. Shubb.

            This case is the product of an extensive investigation by the Sacramento High Tech Crimes Task Force, which includes representatives from state and federal law enforcement agencies including the Sacramento County Sheriff’s Office and the Federal Bureau of Investigation. Assistant United States Attorney Matthew Morris is prosecuting the case. 

            If convicted, Regalado faces a maximum statutory penalty for a violation of trafficking in counterfeit goods of 10 years in prison and a $2 million fine. The maximum penalty for being a felon in possession of firearms or ammunition is 10 years in prison and a $250,000 fine. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.

            The charges are only allegations and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
