Illegal Alien Sentenced For Federal Firearms Offense

           FRESNO, Calif. — United States Attorney Benjamin B. Wagner announced that United States District Judge Lawrence J. O’Neill sentenced Mario Guasan-Caserin, 19, of Fresno, to one year and seven months in prison for being an illegal alien in possession of a firearm.

This case was the product of an investigation by the U.S. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations (HSI), the Bureau of Alcohol, Tobacco, Firearms and Explosives, and the Fresno Police Department. Assistant United States Attorney Kimberly Sanchez prosecuted the case.

According to court documents, on June 27, 2011 Guasan-Caserin was a passenger in a car stopped by police for a rear taillight that was not functioning. Guasan-Caserin had in his possession a loaded .380-caliber Hi-Point pistol with an obliterated serial number along with three .380-caliber bullets. Guasan-Caserin admitted to being a Sureño and being proud of it. Guasan-Caserin was an illegal alien unlawfully present in the United States, as evidenced by his admission to entering in 2007 near Tijuana, and that he never applied for any immigration benefit.

In sentencing, Judge O’Neill acknowledged that Guasan-Caserin’s gang affiliation made him more dangerous.
