Fresno Felons Face Charges For Illegal Firearms Possession

FRESNO, Calif. — United States Attorney Benjamin B. Wagner announced that a federal grand jury returned two separate indictments today charging two Fresno men with being a felon in possession of a firearm.
In the first case, Garry Sampson, 34, was charged with being a felon in possession of a firearm and possession of a firearm after suffering a misdemeanor domestic violence conviction. The indictment alleges that on January 16, 2012, Sampson was in possession of a Glock .40-caliber pistol after having felony convictions for possession of receiving stolen property and possession of a controlled substance while armed.
In the second case, Kyle Gideons, 20, was charged with being a felon in possession of a firearm. The indictment alleges that on December 17, 2011, Gideons was in possession of a Jennings 9 mm pistol after having a felony conviction for robbery.
These cases are the product of investigations by the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Fresno Police Department, and the California Highway Patrol. Assistant United States Attorney Kimberly A. Sanchez is prosecuting the cases.
The maximum statutory penalty for each charge is 10 years imprisonment and a $250,000 fine. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.
The charges are only allegations and the defendants are presumed innocent until and unless proven guilty beyond a reasonable doubt.
