Stockton Man Convicted Of Theft Of Social Security Benefits

SACRAMENTO, Calif. — United States Attorney Benjamin B. Wagner announced that after a three-day jury trial, Dustin E. Bole, 40, of Stockton, was found guilty of stealing federal government money from the Social Security Administration.

According to court records, on October 11, 2007, Bole began to receive Title II Social Security benefits. In order to obtain auxiliary disability benefits, Bole lied to the Social Security Administration (SSA) by claiming that his two children were living with him and that he was caring for them. In fact, Bole was divorced from their mother, the children were not living with him, and he was not even paying the child support that he owed. Bole also lied to SSA about his criminal history by failing to disclose a prior felony conviction. From January 2008 through January 2009 Bole received over $17,000 in children’s auxiliary benefits intended only to be spent for the benefit of the children, but instead spent the money himself.

Bole is scheduled to be sentenced by United States Magistrate Judge Kendall J. Newman on June 6, 2012 at 9 a.m. Bole faces a maximum sentence of one year in prison and a $100,000 fine. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory sentencing factors and the Federal Sentencing Guidelines, which take into account a number of variables.

This case is the result of an investigation by the Social Security Administration Office of the Inspector General. Special Assistant United States Attorneys Nicholas M. Fogg and Christopher S. Hales are prosecuting the case.
