FRESNO, Calif. — United States Attorney Benjamin B. Wagner announced that a federal grand jury returned a two-count indictment charging Alonso Rodriguez-Remegio, 37, of Atwater, for making a false statement in a passport application and being a previously deported alien found in the United States.
According to the indictment, in February 2011, Rodriguez-Remegio used a false name and date of birth in an application for a United States passport. The indictment further alleges that he was found in the United States in March 2012, after being deported in 1996.
This case is the product of an investigation by the U.S. Department of State Diplomatic Security Service and U.S. Immigration and Customs Enforcement’s (ICE) Office of Enforcement and Removal Operations (ERO). Assistant United States Attorney Ian Garriques is prosecuting the case.
If convicted, Rodriguez-Remegio faces a maximum statutory penalty of 20 years in prison, a $250,000 fine, or both. The actual sentence, if convicted, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.
The charges are only allegations, and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
