Bakersfield Man Sentenced To 15 Months In Prison For Failing To Register As A Sex Offender

FRESNO, Calif. — United States Attorney Benjamin B. Wagner announced that United States District Judge Lawrence J. O’Neill sentenced Raul Duarte Ortega, 55, of Bakersfield, to 15 months in prison, to be followed by five years of supervised release for failing to register or update as a sex offender. Ortega will be required to register as a sex offender for life. Ortega has been in custody since his arrest in August 2011.

According to court documents, Ortega has three prior sexual-assault-related convictions. These were California state offenses, for which Ortega is required to register as a sex offender. Ortega, among his other convictions, has been convicted of failing to register as a sex offender. As a result, Ortega is required to register for life under California law. At some point, Ortega moved to Alaska where he was required to register but failed to do so. On September 26, 2008, Ortega returned to California and obtained a California driver’s license in Kern County. Ortega has resided in three different locations within Kern County. As of August 2011, however, Ortega had not registered or updated his registration with Kern County or any other California authorities as required by the Sex Offender Registration and Notification Act.

The Sex Offender Registration and Notification Act, which was enacted as part of the Adam Walsh Act of 2006, mandates sex offenders to register with the authorities. The sex offender must inform the authorities of each county in which the offender resides, works, and is a student.

This case was the product of an investigation by the United States Marshals Service. Assistant United States Attorney Jeremy R. Jehangiri prosecuted the case.
