Stockton Man Indicted For Possessing Methamphetamine

SACRAMENTO, Calif. — A federal grand jury returned a one count indictment today charging Justin Moore, 24, of Stockton, with possession of methamphetamine with intent to distribute, United States Attorney Benjamin B. Wagner announced.

The indictment alleges that on July 12, 2012, Moore possessed a quantity of methamphetamine with the intention to sell it.

This case is the product of an investigation by the U.S. Drug Enforcement Administration (DEA) and the San Joaquin County Metropolitan Narcotics Task Force (METRO). Assistant United States Attorney Jill M. Thomas and Special Assistant United States Attorney Jeffrey A. Spivak are prosecuting the case.

If convicted, he faces a maximum statutory penalty of 40 years in prison and $5 million fine. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.

The charge is only an allegation, and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
