Ceres Man Indicted On Federal Methamphetamine Distribution Charges

FRESNO, Calif. — Jose Barrera, 30, of Ceres, was arraigned today on charges brought by a federal grand jury on Thursday, February 14, 2013, United States Attorney Benjamin B. Wagner announced. Barrera entered a plea of not guilty to the four-counts charging him with distributing methamphetamine and possessing an illegal firearm.

The indictment alleges that on August 30 and December 12, 2012, Barrera distributed five grams or more of methamphetamine, and that he distributed 50 grams or more of methamphetamine on December 14, 2012. The indictment further alleges that he possessed an illegal firearm. He is scheduled to appear for a status conference on March 4, 2013.

If convicted, Barrera faces a maximum statutory penalty of life in prison and a $10 million fine. Any sentence, however, would be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.

The charges are only allegations, and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.

This case is the product of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Modesto Police Department. Assistant United States Attorneys Michael Frye and Kimberly Sanchez are prosecuting the case.
