SAN FRANCISCO-United States Attorney Joseph P. Russoniello announced that Paris Moffett pled guilty in federal court to drug and firearms charges. Moffett was previously found by a San Francisco court to be a member of a criminal street gang.
Moffett entered guilty pleas in federal court on September 10, 2008, to charges that he possessed crack cocaine with the intent to distribute it, in violation of 21 U.S.C. § 841(a)(1), and that he possessed a firearm in furtherance of his drug trafficking activities, in violation of 18 U.S.C. § 924(c). In December 2007, a San Francisco Superior Court judge issued an injunction against the Eddy Rock criminal street gang, named Moffett as a member of that gang, and barred Moffett and his fellow gang members from engaging in criminal activities on the gang’s turf in San Francisco’s Western Addition neighborhood.
At the September 10 court appearance at which he entered his guilty pleas, Moffett admitted that he possessed more than 183 grams of crack cocaine (approximately six-and-a-half ounces) at his home in Novato, California on November 28, 2007. He further admitted that he intended to deliver that crack cocaine to other people. In addition, Moffett admitted to possessing a loaded Colt .45 caliber semi-automatic pistol in furtherance of his drug trafficking activities.
Also on September 10, Moffett’s co-defendant, Delicia Mitchell, pled guilty to possession with intent to distribute MDMA (also known as “Ecstasy”), in violation of 21 U.S.C. § 841(a)(1).
Moffett’s sentencing is scheduled for December 10, 2008, before United States District Judge Maxine M. Chesney. He faces a maximum statutory penalty of life in prison, with a minimum mandatory 10 years in prison, along with a maximum $4 million fine. Mitchell’s sentencing is scheduled for January 14, 2009, before Judge Chesney. However, any sentence for either defendant would be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553.
Drew Caputo and William Frentzen are the Assistant United States Attorneys who are prosecuting the case. The prosecution is the result of an investigation by the San Francisco Police Department, with the assistance of the Novato Police Department and the Federal Bureau of Investigation.
