OAKLAND MAN SENTENCED TO 8 YEARS FOR DISTRIBUTING CHILD PORNOGRAPHY VIDEOS OVER THE INTERNET

OAKLAND – United States Attorney Joseph P. Russoniello announced that yesterday United States District Court Judge Claudia Wilken sentenced defendant Eric Borgerson to 8 years in federal prison and a $50,000 fine as a result of Borgerson’s conviction for distribution of child pornography. Judge Wilken also ordered that Mr. Borgerson must register as a sex offender and serve a 10-year term of supervised release (the federal equivalent of parole) after he is released from federal prison.

Mr. Borgerson pleaded guilty and was remanded to custody on June 25, 2008. In pleading guilty, he admitted that on October 27, 2006, he sent 4 video files of child pornography through Yahoo! Instant Messenger to another internet user using a computer issued by his employer, the University of California at Berkeley. In the plea agreement, Borgerson admitted that the videos he sent showed sexual acts involving prepubescent children. These videos included two videos with sound showing the rape of two prepubescent females, one an infant and the other approximately three to five years of age.

Mr. Borgerson, 42, of Oakland, was indicted by a federal Grand Jury on July 20, 2007. He was charged with one count of distribution of child pornography, in violation of 18 U.S.C. § 2252A(a)(2), and two counts of possession of child pornography, in violation of 18 U.S.C. § 2252A(a)(5).

This guilty plea is the result of an investigation by the Federal Bureau of Investigation and the University of California - Berkeley Police Department. Merry Jean Chan and Denise Marie Barton are the Assistant U.S. Attorneys who are prosecuting the case with the assistance of Tyle Doerr and Rosario Calderon.
