With the dismissal of the felony Information filed against InterMune, Inc., the Deferred Prosecution Agreement between the U.S. Attorney’s Office for the Northern District of California and InterMune, Inc. officially expired on December 10, said United States Attorney Joseph P. Russoniello.
On December 4, 2006, the Government and InterMune entered into the DPA to resolve the ongoing criminal investigation into matters relating to the promotion of the pharmaceutical product Actimmune® (interferon gamma-1b). The Government agreed not to prosecute its filed Information if the company complied with all of the terms of the DPA. The dismissal of the Information is a result of the Northern District of California’s satisfaction that the company has complied in full with the terms of the DPA.
