OWNER OF LOS ALTOS PILATES STUDIO SENTENCED TO 70 MONTHS PRISON, ORDERED TO PAY $10,000 FINE FOR POSSESSING CHILD PORNOGRAPHY

Defendant Remanded Into Custody After Sentencing

SAN JOSE, Calif. – Kenneth Van Aalsburg last week was sentenced to 70 months in prison and ordered to pay a $10,000 fine for possessing child pornography, announced United States Attorney Joseph P. Russoniello.

Van Aalsburg, 60, of Santa Clara, Calif., the owner of Fitness Concepts of Los Altos Pilates Studio in Los Altos, Calif., pleaded guilty on April 28. After a contested evidentiary hearing, the Court made factual findings for purposes of sentencing. The Court found that the Government had proved that the defendant possessed more than 600 images of child pornography, including images portraying sadistic and masochistic conduct, as well as images involving prepubescent minors. The Court also found that the defendant distributed images of child pornography with the expectation of receipt of a thing of value.

The sentence was handed down by United States District Court Judge James Ware following a guilty plea to a single count information in violation of 18 U.S.C. § 2252(a)(4)(B). In addition to ordering Van Aalsburg to pay a $10,000 fine and sentencing him to serve 70 months in federal prison, Judge Ware ordered Van Aalsburg to serve a ten-year term of supervised release following his release from prison. The sentence also required that the defendant register as a sex offender and that he not have any unauthorized or unsupervised contacts with minors. At the conclusion of the sentencing, Judge Ware remanded Mr. Van Aalsburg into custody pursuant to the Bail Reform Act.

Joseph A. Fazioli is the Assistant United States Attorney who prosecuted the case with the assistance of Legal Assistant Jeanne Carstensen. This prosecution is the result of an investigation by U.S. Immigration and Customs Enforcement.
