SAN FRANCISCO – A federal grand jury indicted Harry Warren Green, yesterday with four counts of filing false tax return, United States Attorney Joseph P. Russoniello and Special Agent in Charge, IRS Criminal Investigation, Scott O’Briant announced.
According to the indictment, for the 2000 through 2002 tax years, Green is alleged to have aided or assisted in filing a false tax return that omitted gross receipts from his newspaper publications that include the Clayton Pioneer, Brentwood Bee and others. According to the indictment, Green was aware that he was under-reporting his income when the tax returns were filed with the Internal Revenue Service. The indictment also alleges that Green failed to report gross receipt and capital gain income for the 2003 tax year. Green is scheduled to make his initial appearance in federal court in Oakland on September 21.
The maximum statutory penalty for each count of filing a false tax return in violation of Title 26 U.S.C. § 7206(2) is three years in prison and a fine of $250,000, plus restitution. However, any sentence following conviction would be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553.
Thomas Newman is the Assistant U.S. Attorney who is prosecuting the case with the assistance of Kathy Tat. The prosecution is the result of an investigation by the Internal Revenue Service Criminal Investigation.
Please note, an indictment contains only allegations against an individual and, as with all defendants, Green must be presumed innocent unless and until proven guilty.
