Elements—18 U.S.C. § 1584—Involuntary Servitude

  1. The defendant held the victim in involuntary servitude.

  2. Such holding was for a term, that is, any period of time.

  3. The defendant used force, threat of force, or threat of legal coercion.

  4. The defendant acted knowingly and willfully.

Consult with the involuntary servitude coordinator in the Criminal Section before making a prosecutive determination for cases involving possible violations of the peonage or involuntary servitude statutes. The current coordinator is Lou de Boca.
