Contingent upon defendants' payment of the sum of $ 190,000.00, to be distributed as follows: $ 65,000.00 in compensatory damages to me; $ 125,000.00 to the law firm of Goldfarb and Abrandt for attorneys' fees pursuant to the provisions of the Consent Order entered on ____________________, 1995, in Shapiro v. Cadman Towers, Inc. and Sydelle Levy, CV 93-5764, and United States v. Cadman Towers, Inc. and Sydelle Levy. CV 93-5860, I, Phyliss Shapiro, hereby release and forever discharge Defendants in that case, their current, former and future officials, employers and agents, of and from all legal and equitable or administrative claims or causes of action arising out of any alleged discrimination on the basis of handicap with respect to housing at Cadman Towers in violation of any Federal, state or local equal housing opportunity laws, statutes, regulations or ordinances occurring before the execution of this Release.

I understand that the payment to be made to me and/or other relief to be offered to me does not constitute an admission by any of the parties released of the validity of any claim raised by me, or on my behalf.

This release and the Consent Order constitute the entire agreement between the Defendants and myself, without exception or exclusion.

I acknowledge that a copy of the Consent Order in this action has been made available to me.

I HAVE READ THIS RELEASE AND UNDERSTAND THE CONTENTS THEREOF AND I EXECUTE THIS RELEASE OF MY OWN FREE ACT AND DEED.

APPENDIX B

NOTICE TO ASSOCIATES OF NONDISCRIMINATION POLICY

This notice is to make you aware of the nondiscrimination policy of Cadman Towers, Inc. It is the policy of Cadman Towers, Inc. to comply with Title VIII of the Civil Rights Act of 1968 (commonly known as the Fair Housing Act), as amended by the Fair Housing Amendments Act of 1988 by ensuring that cooperative units are available to all persons without regard to handicap, and that the terms and conditions of rental and sale are the same for handicapped persons as they are for anyone else.

It is required that any entity employed or otherwise engaged by Cadman Towers, Inc. for the purpose of making solicitations or referrals for the rental of apartments must follow this nondiscrimination policy. Violation of this policy could subject it or them to termination of the agency or employment relationship and to possible sanctions by the Court.

LETTER TO EMPLOYEES

Dear Employee:

This letter is to make you, an employee or agent of Cadman Towers, Inc., aware of Cadman Towers' non-discrimination policy. It is the policy of Cadman Towers to comply with Title VIII of the Civil Rights Act of 1968 (commonly known as the Fair Housing Act) as amended by the Fair Housing Amendments Act of 1988 by ensuring that cooperative units are available to all persons without regard to handicap, and that the terms and conditions of rental and sale are the same for handicapped persons as they are for anyone else.

It is required that all employees or agents of Cadman Towers, Inc. adhere to these policies. Disciplinary action, up to and including dismissal, will be taken against any employee who is found to have violated these policies, and, in addition, the employee may be subject to court sanctions.
