Tolling of Statute of Limitations
| |
The running of statutes of limitations is tolled during periods of
fugitivity. 18 U.S.C. § 3290. Physical absence from the jurisdiction
is not
required to trigger this tolling provision. See United States v.
Singleton, 702 F.2d 1159 (D.C.Cir. 1983); United States v.
Wazney, 529
F.2d 1287 (9th Cir. 1976).
The running of a statute of limitations may also be tolled, on
application of the United States, during the pendency of an official request
to
a foreign court or authority to obtain evidence located in a foreign
country.
See 18 U.S.C. § 3292.
