Financial Analysis Worksheets

A written financial analysis is required to facilitate and to
document
pre-seizure planning decisions. In cases where information relating to
titles
and liens cannot be acquired without compromising the investigation, the
financial analysis may be completed post-seizure. See Avoiding Liability
Seizures, USAM 9-111.123, and the sample
financial analysis worksheet in this Manual at
2279.
A United States Attorney may adopt this form or develop his or her own.
The investigative agency is responsible for ensuring that current
and
accurate information on the ownership of, and any encumbrances against,
personal
property targeted for forfeiture is compiled prior to the seizure of the
property
and is made available to the United States Marshals Service and the United
States
Attorney prior to seizure. In instances where real property and businesses
are
targeted for seizure, the Marshals Service will have primary responsibility
for
conducting a title search prior to seizure unless otherwise agreed in
individual
cases.
