Seizure of Personal or Cashiers' Checks

Immediately following seizure of personal or cashiers' checks, the seizing agency should notify the bank upon which the check is drawn that the check has been seized for forfeiture; direct the financial institution to take whatever steps are necessary to prevent the withdrawal or transfer of funds necessary to pay the government after forfeiture; and provide a copy of this notice to the Marshals Service at the time the check is transferred for custody.

The Marshals Service will accept custody of all checks as to which the investigative agency has contacted the bank on which they were drawn and negotiate the checks after receipt of a declaration or order of forfeiture, in accordance with established procedures.
