2013 Organized Crime Coordinator and Strike Force Chief Training

This training is designed for Assistant United States Attorneys and Department of Justice Criminal Division attorneys who have been designated Organized Crime Strike Force Chiefs (OCSF Chiefs) and/or Organized Crime Coordinators (OC Coordinators). The two-day conference will be dedicated to issues of particular relevance to prosecutors of international, emerging, and traditional organized crime cases, and topics will span the areas of litigation, investigation, resources, trends, strategies, and tactics used in efforts to dismantle criminal conspiracies. In addition, OCSF Chiefs will lead discussions concerning their recently completed Organized Crime Threat Assessment and Strategy reports. The Organized Crime and Gang Section and OCSF Chiefs will discuss the process and substance of these reports, which are required of all OC Coordinators pursuant to the Attorney General's September 20, 2010, Order "Modernizing the Department of Justice Organized Crime Program."

AFMLS/Attorney General's Organized Crime Council/Organized Crime and Gang Section Financial Investigations Seminar

This practical, innovative, and interactive seminar is designed to enhance the participants' investigative skills while following the money trail of a criminal enterprise. Through a comprehensive use of a video-based case study, financial documents, lectures, and activities, the seminar will provide the participants an opportunity to apply techniques and strategies to identify and track assets for forfeiture, analyze bank documents and tax records, anticipate legal defenses and determine how to overcome them, and determine which money laundering and RICO statutes have been violated and should be charged. Participants will discuss the case study as a team and will take turns reporting the team's investigative results to the entire group. Modules such as "Proving Unexplained Income," "Obtaining and Analyzing Bank Documents," "BSA Reporting Requirements," "RICO," and "Tracing the Money" will be highlighted. This is a basic seminar. The objective of this seminar is to apply investigative techniques and methods to unravel the case study's money laundering scheme, to identify assets for forfeiture, and to make charging and forfeiture decisions. Using videos to illustrate the case study involving a drug enterprise, this practical, innovative, and interactive seminar is designed to introduce participants to financial investigations, money laundering, and asset forfeiture. During the seminar, participants will analyze financial documents to establish links among the targets, assets, and the illegal activities. This seminar is open only to participants with five years or less experience in financial investigations, asset forfeiture, and money laundering.

Adverse Actions Seminar

This course is designed for supervisors/managers, management advisors, and agency representatives who take and/or defend adverse actions before the Merit Systems Protection Board. It is required for advisors and representatives, but supervisors and managers are also encouraged to attend. The course will consist of separate tracks for each group, plus combined and plenary sessions that address issues of general interest. The sessions for supervisors and managers will focus on issues such as preventing the need for formal discipline, investigations, and addressing performance and conduct problems in a legally defensible way. In addition to providing guidance on such issues, the training will acquaint supervisors and managers with the Department resources available to them to assist in preventing and resolving problems in this area. Advisors and representatives will attend sessions that address framing charges, writing/reviewing notices, considering Douglas factors on the penalty issue, preparing the administrative record, discovery, understanding and defending against affirmative defenses, and related issues, such as hearing preparation, settlement, interim relief, and petitions for review. Part of the course schedule is devoted to problem-solving of a specific case study in small groups of no more than 20 participants. Each of those groups will consist of a cross-section of participants and will be guided by experienced advisors and/or representatives. Please note that while CLE credits will be available, the course will not contain an ethics session, so you will not be able to claim CLE ethics credit.

Anti-Terrorism Advisory Council Coordinators' Training

This is the annual anti-terrorism training for Anti-Terrorism Advisory Council (ATAC) Coordinators, other anti-terrorism prosecutors in the United States Attorneys' Offices (USAOs), and National Security Division attorneys. The training is appropriate for prosecutors who spend the majority of their time focusing on international terrorism investigations and prosecutions. Presentations will focus mostly on current international terrorism threats and analysis; Department policies governing international terrorism matters; criminal and intelligence investigative resources; and complex issues arising in international terrorism investigations. Presentations will include case studies and lessons learned in some of the significant terrorism cases investigated and prosecuted during the past year. We will also include sessions on domestic terrorism, national security cyber threats, and counterintelligence/counterespionage investigations and prosecutions. Most of the presentations will be conducted at an intermediate to advanced experience level; however, prosecutors new to counterterrorism who will focus primarily on international terrorism are also encouraged to attend.

Basic Criminal Trial Advocacy Seminar

This seminar is an intensive advocacy skills program designed for new federal prosecutors with little or no trial experience and who will be responsible for the trial of criminal cases. This seminar utilizes lectures, skills exercises, critiques, and trial strategy sessions. Substantial preparation is required in advance of and throughout the training. Course materials will be emailed to each student in advance of the course. Using the facts of the case contained in the course materials, all students will be required to prepare and submit their Opening Statement and Direct Examination of Special Agent Terry Booth to Willie Miller at willie.d.miller@usdoj.gov no later than three weeks prior to the course start date. Students are required to be in full command of the facts of the case in advance of their arrival, and to be able to perform both as advocates and in witness roles on the first day of the course.

This seminar is designed to provide hands-on training to relatively new users of the Victim Notification System (VNS). The training seminar will involve exercises in the VNS application to search the database, add victims, generate notifications to victims, and create VNS form letter notifications. CATS for Experts Training

This is an annual meeting of CATS experts from the United States Attorneys' Offices to review changes made to CATS during the previous year and to discuss any problems with CATS that may require additional modifications. This course is also a good opportunity for CATS users who have not been to CATS training for a number of years to become familiar with the various enhancements which have been made to CATS. Attendees will be asked to provide specific issues and/or questions before class for discussion and resolution. They will also have an opportunity to run CATS reports with an emphasis on analyzing data to clean up discrepancies captured on the system. Nominees for this course must have approximately three years of experience in asset forfeiture and must have attended basic and intermediate CATS training classes. Contract employees may also be nominated.

CDCS Document Generation: WordPerfect to Word Conversion

This hands-on course is designed to provide the Financial Litigation Units (FLU) the tools necessary to convert existing documents used in the Consolidated Debt Collection System (CDCS) document generation program from WordPerfect to Word. The attendees will be given time to convert some of their own documents with a goal of leaving the course with some of their own documents ready to use in their home office, an understanding of the conversion process, and an understanding of using Word for its Document Generation purposes. The goal of this skills seminar is to strengthen brief-writing and oral-argument skills. The seminar will consist of class lectures, brief-writing exercises that will focus on specific parts of an appellate brief, oral arguments, and videotape reviews and critiques of oral arguments. During the course, the attendee will also be required to participate in a mock oral argument before a circuit judge. Computer Forensics Seminar

This workshop provides prosecutors with a solid foundation for understanding computer forensics. It addresses the types of evidence and information that can be obtained from a computer forensic analysis, and it equips prosecutors with the knowledge needed to ask the right questions to obtain the specific information needed for prosecution. It also provides training on how information got on a computer, if it has been accessed, and in many cases, who is responsible for the activity on the computer. The course covers areas such as, but not limited to, the preparation of a warrant for electronic evidence; technical and legal issues; and execution of a warrant for electronic evidence. The training includes plenty of hands-on demonstrations, and participants receive the latest legal information on pretrial discovery issues and direct and cross examination of a computer forensics expert witness.

Counterterrorism Training for Anti-Terrorism Prosecutors and JTTF Agents

This joint training is for all levels of Anti-Terrorism Prosecutors, JTTF agents, and Intelligence Specialists (IS) who spend more than fifty percent of their time on international terrorism matters. Each Anti-Terrorism Prosecutor is encouraged to invite one JTTF agent to attend the conference, and priority will be given to teams that include one Anti-Terrorism Prosecutor and one agent or IS from the same district (Anti-Terrorism Prosecutors must obtain the approval from the nominated agent's supervisor before nominating the agent). The Office of Legal Education will pay travel, lodging, and per diem expenses for all approved attendees, including the JTTF agents.

Courtroom Presentations Seminar

This 3?-day course is a basic course designed to familiarize students with the use of currently available Legal Information Technology (LIT) applications in the trial phase of a criminal or civil case. Students selected to attend this course will receive hands-on training on the Sanction II.9 and TimeMap 5 applications. The Sanction II.9 portion of the course will cover: creating a case by using the drag and drop method, as well as using load files from eScan-IT, LAW PreDiscovery, IPRO, and iConect; creating presentation folders; using the Presentation mode in court; synchronizing audio and video files with a corresponding transcript; making clips of media files; and using the print option. The TimeMap 5 portion of the course will cover how to create a time line in the application, as well as creating a timeline directly from a CaseMap case. At the conclusion of the course, students complete an individual project which will culminate with a mock trial.

The goal of this seminar is to strengthen brief-writing and oral argument skills. This conference is designed for all Criminal Discovery Coordinators. Criminal Federal Practice Seminar

This introductory seminar is designed to teach new federal prosecutors the principles governing the prosecution and trial of federal criminal cases. Lecture topics will include drafting complaints, indictments and search warrants; grand jury practice; magistrate court practice; the use of cooperating defendants; plea bargaining; evidence; and asset forfeiture. This course will also include ethics credit. This course is open to AUSAs and Division attorneys and also to Special Assistant United States Attorneys (SAUSAs) who are nominated by their districts.

Criminal Jurisdiction in Indian Country

This course is for law enforcement officers who fulfill all other BIA minimum requirements to receive an SLEC and for USAO personnel who have responsibility under TLOA to teach the CJIC class but may not have experience with the class format and materials. By way of background, the Bureau of Indian Affairs (BIA), Office of Justice Services (OJS), issues Special LawEnforcement Commissions (SLECs) to Tribal, Federal, state, and local full-time certified law enforcement officers who will serve without compensation from the Federal government. This process allows BIA to obtain active assistance in the enforcement ofFederal criminal statutes and Federal hunting and fishing regulations in Indian country. One of the criteria for receiving a SLEC is attendance at the Criminal Jurisdiction in Indian Country (CJIC) course and passage of an exam at the end of the class with a score of 70 percent or higher.While the SLEC is still issued by BIA, passage of the Tribal Law and Order Act of 2010 shifted primary responsibility for delivery of CJIC training to DOJ.

Defending Federal Employees in Personal Liability Litigation

This course will focus on representing federal employees in their individual capacities under 28 C.F.R ? 50.15. Particular emphasis will be placed on personal-liability, constitutional tort (Bivens) claims. Common defense strategies will be covered, such as the "special factors" doctrine and qualified immunity. There will also be emphasis on the professional responsibility and ethical concerns arising in this context, such as conflicts between clients. New for this year, this course will cover discovery issues (both electronic and non-electronic) that arise in this type of litigation. Finally, a variety of related topics will be featured, including appellate practice and non-litigation concerns. The course format includes lectures, small-group workshops and an open forum on the final day. Students will receive a CD containing the lecture handouts, the workshop problems and the latest version of all the Constitutional Torts Staff monographs.

Discovery Boot Camp for New Prosecutors Seminar

The training is limited to criminal attorneys in the United States Attorneys' Offices and the Department's Litigating Divisions. This course is designed to comply with the mandate of discovery training for new prosecutors that requires all new federal prosecutors assigned to criminal cases to complete in their first twelve months of employment training on Brady, Giglio, and other DOJ disclosure obligations and policies. The course will focus on a variety of discovery-related issues, including Brady, Giglio, Rule 16, Jencks, electronically stored information (ESI) in criminal cases, DOJ guidance on disclosure of electronic communications and other ESI, and commonly encountered discovery issues, such as agent and attorney notes. Faculty will provide substantive information through lectures and discussion of a series of hypothetical scenarios. Smaller breakout sessions also will be held to give students the opportunity to apply the information learned to a hypothetical case. At the conclusion of the course, students will be familiar with the guiding legal principles and Department policies regarding disclosure obligations in criminal cases, and will be able to apply those principles and policies to their own criminal cases.

This 3.5 day course deals with using computer technology to electronically capture, store, and organize documents on a local district server in civil or criminal cases. The emphasis of this course is on using Concordance, LAW PreDiscovery, IPRO and CaseMap during the document review and production phases of the litigation process. Concordance will focus on creating databases to manage large document cases and how to conduct searches after the databases are created. LAW PreDiscovery will focus on creating .tif files from native files, and the process for moving the .tif files into IPRO. IPRO Build will be used for creating production datasets for opposing counsel. Finally, CaseMap will be used for case organization throughout the entire life of the case. This is an introductory course, and attendees should not expect to be an expert on these applications at the conclusion of this course. Document Imaging (LAW PreDiscovery) is a prerequisite for this course.

This is a basic seminar for prosecutors. Criminal investigations of all types can now involve electronic evidence, which can take many forms: data taken from a suspect's hard drive, e-mail obtained from a service provider, or cell-phone location information. The materials in this course are useful for prosecuting crimes as diverse as terrorism, drug offenses, health care fraud, and gang offenses. Students will be introduced to concepts and techniques for obtaining online evidence, such as e-mail, the search and seizure of computers, and the investigation and prosecution of computer-related crimes. The seminar will include presentations on computers, understanding the Internet, e-mail, cell phones, social networking, international issues, search and seizure of electronic evidence, online investigations, data forensics and analysis, obtaining and admitting electronic evidence, prosecuting computer crimes, and prosecuting intellectual property crimes. Indian Country Strangulation and Suffocation Seminar

Strangulation has been identified as one of the most lethal forms of domestic violence and sexual assault. This four-day course is designed for experienced federal and tribal multi-disciplinary professionals (prosecutors, law enforcement officers, advocates, medical professionals) who work domestic violence and sexual assault cases in Indian Country. This course will provide an indepth examination of the mechanics of strangulation and suffocation from a medical, legal, and law enforcement perspective. Further, this course is intended for personnel who serve as either trainers or expert witnesses in their jurisdiction. Those selected to attend the class will receive instruction on effective training techniques, how to develop a training curriculum, an overview of courtroom procedures, and instruction on how to use expert witnesses in court. This is a skills-based course. Participants will be required to prepare and present training on strangulation and suffocation during the class. In addition, there will be courtroom exercises focused on the introduction and use of expert witness testimony in a strangulation and/or suffocation case. Participants are encouraged to register as a team. For example, a prosecutor and investigator or a prosecutor and a medical provider may register as a team. Individual registrations will be considered.

Intermediate Criminal Trial Advocacy Seminar

This seminar is an intensive advocacy skills program designed for new federal prosecutors with previous trial experience as a state court prosecutor or as a member of the military's Judge Advocate General's Corps. This seminar is also designed to teach new federal prosecutors the principles governing the prosecution and trial of federal criminal cases. Lecture topics will include overviews of grand jury practice, pre-trial discovery and motion practice, trial preparation, the Federal Rules of Evidence, and the U.S. Sentencing Guidelines. This course is open to AUSAs, DOJ Litigating Division attorneys, and Special Assistant United States Attorneys (SAUSAs) who are nominated by their districts. This seminar is designed for Assistant United States Attorneys (AUSAs) newly assigned (three years or less) to financial litigation programs in the United States Attorneys' Offices. As debtors have become more sophisticated in hiding and/or dissipating their assets prior and subsequent to conviction and judgment, it is important that AUSAs with financial litigation responsibilities be aware of and understand the emerging issues in enforcing and collecting criminal monetary penalties, as well as civil debts. The seminar will provide basic instruction on criminal pre-judgment strategies, pre- and post-judgment enforcement pursuant to the Federal Debt Collections Procedures Act, the Mandatory Victims' Restitution Act, the Crime Victims' Rights Act, and management issues. This training will utilize lectures and discussion groups to provide theoretical insight and practical approaches on the day-to-day aspects of practicing financial litigation, focusing on the enforcement and collection of civil and criminal monetary impositions and judgments for victims of crime and the United States. This seminar is an introductory course for attorneys new to money laundering prosecutions. The seminar will provide a basic introduction to criminal prosecutions under the currency reporting and currency smuggling statutes: 31 U.S.C. Sec. 5313, 5316, 5324, 5331, and 5332; the traditional money laundering statutes: 18 U.S.C. Sec. 1956 and 1957; and the unlicensed money transmitting business statute: 8 U.S.C. Sec. 1960. Motion Practice and Brief Writing for Civil Attorneys Seminar

This course will cover dispositive and non-dispositive motions, with a particular focus on summary judgment. Topics include: motion planning, strategic considerations in filing motions, effective structure and organization, constructing artful declarations, statements of fact, reply brief strategy, and oral argument as well as systematic approaches to summary judgment in a Federal Tort Claims Act (FTCA) case. Model case materials utilized in this seminar are premised upon a FTCA action. The method of instruction includes lecture, independent study, and writing assignments. Each student will be expected to submit a writing assignment, one month in advance of the course, for faculty review and individual editing assistance. The assignment will require participants to review model case materials and draft portions of motions prior to arriving at the NAC. The program will culminate in videotaped oral argument before federal judges.

This symposium is part of the continuing Export Enforcement Initiative announced by the Assistant Attorney General, National Security Division. The symposium will consist of an introduction to export control law, with a strong emphasis on the presentation of case studies by experienced AUSAs. The case studies will illustrate how these AUSAs have tackled the challenging and sophisticated issues present in such investigations and prosecutions. The first day of this seminar will be dedicated to basic child exploitation crimes topics, including an overview of child exploitation statutes, computer forensic fundamentals, and certain search and seizure issues, including the Electronic Communications Privacy Act (ECPA). This session is designed to give attorneys who are new to prosecuting Project Safe Childhood (PSC) cases the foundation for the remainder of the seminar, but also to provide refresher training for more experienced PSC prosecutors. There remaining four days of the seminar will address the most current challenges in federal child exploitation cases. The seminar's goal is to help prosecutors effectively prepare, present, and argue the government's case by focusing on cutting edge investigative and prosecutorial strategies and techniques in gathering evidence. The seminar will address challenges posed by technological developments, such as anonymization, encryption, mobile devices and cloud-based storage, as well as the emerging legal issues unique to these technologies. Significant focus will also be placed on the investigation and prosecution of child exploitation offenses that were recently incorporated into the PSC initiative, including domestic prostitution of minors, sexual exploitation of children who are outside of the United States, and child sex offender registration enforcement. In addition, the seminar will provide prosecutors with up-to-date information in the continuously evolving areas of sentencing, restitution, civil commitment, and victim rights and privacy interests.

Sentencing Guidelines Seminar

NOTE: You will be able to register for a scheduled offering of this course only after completing the Prerequisite Survey. Prerequisites are listed under the Item Details. This introductory course is designed to teach new federal prosecutors the principles governing federal sentencing outlined at 18 U.S.C. ? 3553, including the correct application of the sentencing guidelines. Members of the Sentencing Commission staff will discuss application issues contained in the Guidelines Manual. Participants will then get an opportunity to apply the guidelines in a small group setting, working with experienced Assistant United States Attorneys (AUSAs). The factors at 18 U.S.C. ? 3553(a), which ultimately guide the court in establishing an appropriate sentence, will also be discussed. This course will also include ethics credit. This course is open to AUSAs and Division attorneys and also to Special Assistant United States Attorneys (SAUSAs) who are nominated by their districts.

Stolen Identity Refund Fraud (SIRF) Conference

The course will address issues related to Stolen Identity Refund Fraud crimes in the context of new Tax Directive 144 (effective October 1, 2012) which grants authority to United States Attorneys to open tax-related cases and grand jury investigations in SIRF matters, file criminal complaints, and obtain seizure warrants for fraud proceeds resulting from SIRF crimes, all without prior approval from the Tax Division. The course will review the new policy and procedures accompanying Tax Directive 144 and the respective roles of the United States Attorney's Office, the Tax Division, and IRS-CI, in the investigation and prosecution of SIRF crimes. Special attention will be given to the roles of SIRF points-of-contact within the United States Attorneys' Offices and the plan for them to report information about SIRF cases to the Tax Division. In addition, the course will address substantive issues associated with the investigation and prosecution of the unique mix of street crime and tax administration present in SIRF cases. The course will include presentations by prosecutors, special agents, and supervisory agents responsible for combating SIRF crimes, and it will explore successful strategies designed to meet the various demands placed upon law enforcement officials responsible for addressing these fast-growing crimes. Course attendees should be the SIRF point-of-contact within the United States Attorney's Office and/or the prosecutor(s) most responsible for handling or supervising the prosecution of SIRF cases within the office.

Trade Secrets/Economic Espionage

This course is intended for prosecutors and federal agents who investigate and prosecute trade secret theft and economic espionage cases. The course is designed to provide a practical learning experience based on case studies, panel discussions, and topical lectures. Topics will include best practices in investigating and charging trade secret cases; the use of protective orders to guard trade secrets during the criminal justice process and other discovery issues; special issues involving related civil litigation; working with industry; sentencing and valuation issues; the differences between trade secret theft and economic espionage; and the approval process for charging economic espionage. A number of recent trade secret and economic espionage act cases will be featured. The course will also feature model documents and checklists for trade secret cases. At the conclusion of the course, students will have a practical understanding of key trade secret issues and an enhanced ability to investigate and prosecute these cases. Prosecutors who have agents conducting trade secret and/or economic espionage investigations and feel they would benefit from this training should provide the agents contact information on the pre-course nomination survey. This course is for victim witness personnel with over two years of experience working with victims and will focus on the complex challenges encountered when assisting minor victims of child pornography, domestic prostitution of children, travel for sex with children, and other types of cases with minor victims and witnesses.
